Board of County Commissioners <br />Meeting Minutes - Final January 15, 2019 <br />Director of Utility Services Vincent Burke gave a brief background of Phase II <br />of the West Wabasso Septic to Sewer Project and reviewed the funding sources <br />for the project. After discussing the bids received for the project, he <br />recommended that the bid award be granted to CK Contractors and <br />Development. <br />Commissioner O'Bryan questioned staff about covering the costs of the sewer <br />impact fees. Director Burke affirmed that those fees would be covered by one <br />of the County's grants. He (Commissioner O'Bryan) recalled that the new bid <br />came in much lower than the original bids and voiced appreciation to Assistant <br />County Attorney Kate Pingolt-Cotner for her work with the Florida Department <br />of Environmental Protection (FDEP), and to the community for supporting the <br />Board's decision to defer the project until costs decreased. <br />Ardra Rigby, President of the West Wabasso Progressive Civic Club, thanked <br />the Board and staff for the project. <br />A motion was made by Commissioner Flescher, seconded by Vice Chairman <br />Adams, to approve staffs recommendation. The motion carried by the following <br />vote: <br />Aye: 5 - Chairman Solari, Vice Chairman Adams, Commissioner Flescher, Commissioner <br />O'Bryan, and Commissioner Zorc <br />13. COUNTY ATTORNEY MATTERS <br />13.A. 19-0013 Anti -Smoking Resolution <br />Recommended Action: The County Attorney's Office recommends that the Indian River County Board of <br />County Commissioners approved the resolution. <br />Attachments: Draft resolution -Anti-Smoking <br />Staff Report <br />County Attorney Dylan Reingold recapped a series of items approved by the Board <br />on December 11, 2018, with regards to limiting smoking at parks and recreational <br />facilities. He stated that the proposed anti-smoking Resolution compliments the <br />City of Vero Beach's Resolution 2012-02, and that the goal of the legislation is to <br />discourage, but not prohibit, tobacco use at these venues. The Resolution will not <br />conflict with the State of Florida's preemption on smoking regulations. <br />Commissioner O'Bryan sought and received confirmation that the venues included <br />beaches. He also mentioned that Leslie Spurlock, Facilitator of the Tobacco Free <br />Partnership of Indian River County, had suggested adding specific language <br />regarding electronic smoking devices in the Resolution. <br />Indian River County Florida Page 11 <br />
