8.E. <br />CONSENT <br />INDIAN RIVER COUNTY, FLORIDA <br />BOARD MEMORANDUM <br />TO: Jason E. Brown, County Administrator <br />THROUGH: Richard B. Szpyrka, P.E., Public Works Director <br />FROM: Kendra Cope, M.S., Coastal Resources Coordinator <br />SUBJECT: Resolution to Florida Department of Environmental Protection requesting <br />establishment of an Erosion Control Line for the Sector 5 Beach Restoration <br />Project <br />DATE: March 22, 2019 <br />DESCRIPTION AND CONDITIONS <br />As a part of the permitting process for the Sector 5 Beach Restoration Project, the State requires that <br />an Erosion Control Line (ECL) be established over the entire project area. The ECL identifies the <br />location of Mean High Water (MHW) level in the project area, the traditional dividing line between <br />private property to landward and public property to seaward. Once an ECL has been established, it <br />becomes the new dividing line between public and private property, ensuring that new beach land <br />created seaward of the previous MHW line is public property. The County's Consultant, Morgan & <br />Eklund, Inc., will begin surveying the beach within the Sector 5 project area on April 1, 2019 to <br />determine the position of MHW. The State requires a resolution from the Board of County <br />Commissioners, formally requesting that an ECL be established for the project area. Following the <br />resolution, the County will release a public notice of an ECL workshop and public hearing required by <br />Statute. <br />FUNDING <br />Funding is not required for executing a resolution in support of establishing an ECL within the Sector <br />5 project area.
