County Attorney Vitunac reported on a meeting he attended <br />where he discovered that Indian River County is in the best shape <br />of anybody in the country as the magic date for continuation of <br />flow control rights in counties was May 15, 1994. The County's <br />ordinance which requires garbage to go to our facilities was <br />adopted in 1987 and bonds were issued in reliance on that flow, so <br />we are in good shape as long as Congress passes this bill. Without <br />this bill it would mean that we cannot control the flow into our <br />own facilities. There was general disagreement on what would <br />happen if no bill was passed, but generally it was thought the bill <br />would pass in Congress. They went over the very lengthy detailed <br />bill for 7 hours, proposing amendments to solve all of the problems <br />of the counties that were represented. The meeting was not <br />advertised and no minutes were taken for the reason that the NACo <br />people did not want the industry to know exactly what they were <br />discussing. It is hoped that now, with the new Congress and some <br />amendments to the bill, it will pass very soon in the next Congress <br />and we will be taken care of. <br />Chairman Macht, as a side note, mentioned that we were invited <br />to participate in the meeting because we had worked with NACo in <br />lobbying our congressional delegation, both the senate and the <br />house. He felt we need to continue lobbying with the change in the <br />makeup of our delegation. He is drafting a letter to our new <br />representative and suggested that each commissioner might want to <br />do the same, as well as to ask members of the council, public <br />officials and others to also write. He expressed his opinion that <br />we have enough cost to bear in the solid waste effort and that if <br />they do not pass a decent flow control bill, it's going to get very <br />unpleasant. <br />Commissioner Eggert suggested that the Board send a letter or <br />a resolution as a body and also have anyone individually that wants <br />to, follow up. <br />MOTION WAD MADE by Commissioner Eggert, SECONDED by <br />Commissioner Tippin, that the Board adopt Resolution <br />95-07 to the United States Congress, urging passage <br />of a solid waste flow control bill. <br />JANUARY 3, 1995 35 <br />BOOK <br />
