ORDINANCE NO. 2019- 017 <br />AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING THE ZONING <br />ORDINANCE AND THE ACCOMPANYING ZONING MAP FOR APPROXIMATELY <br />±19.24 ACRES LOCATED SOUTH OF 65th STREET, WEST OF LATERAL "G" CANAL, <br />AND EAST OF 48th AVENUE FROM RS -3, SINGLE-FAMILY RESIDENTIAL DISTRICT <br />(UP TO 3 UNITS/ACRE), TO RS -6, SINGLE-FAMILY RESIDENTIAL DISTRICT (UP TO 6 <br />UNITS/ACRE), AND PROVIDING CODIFICATION, SEVERABILITY, AND EFFECTIVE <br />DATE. <br />WHEREAS, the Planning and Zoning Commission, sitting as the local planning agency <br />on such matters, held a public hearing and subsequently made a recommendation regarding this <br />rezoning request; and <br />WHEREAS, the Board of County Commissioners of Indian River County, Florida, did <br />publish and send its Notice of Intent to rezone the hereinafter described property; and <br />WHEREAS, the Board of County Commissioners held a public hearing pursuant to this <br />rezoning request, at which parties in interest and citizens were heard; and <br />WHEREAS, the Board of County Commissioners determined that this rezoning is in <br />conformance with the Comprehensive Plan of Indian River County. <br />NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of <br />Indian River County, Florida, that the zoning of the following described property situated in <br />Indian River County, Florida, to -wit: <br />That portion of Tracts 5 through 6 located in Section 9, Township 32S, Range 39E according to <br />Indian River Farms Co. as recorded in Plat Book 2, at Page 25, of the Public Records, Indian <br />River County, Florida lying west of Lateral "G" canal right-of-way, north of Sub -Lateral "G-2" <br />canal right-of-way, and south of 65th Street right-of-way. Furthermore described as follows: <br />COMMENCING at the east quarter corner of said Section 9; THENCE South 00°11'45" West, <br />30.00 feet along the east line of the southeast quarter of said Section 9; THENCE South <br />89°40'38" West, 1430.52 feet along the south right-of-way line of said 65th Street (80 foot right- <br />of-way) to the Point of Beginning; <br />THENCE South 14°14'45" East, 93.48 feet along the west right-of-way line of said Lateral "G" <br />(160 foot right-of-way); <br />Pau 1 of 3 <br />
