A TRUE COPY <br /> RESOLUTION NO.2019-089 CERTIFICATION ON LAST PAGE <br /> J.R.SMITH, CLERK <br /> A RESOLUTION OF THE BOARD OF COUNTY <br /> COMMISSIONERS OF INDIAN RIVER COUNTY, <br /> FLORIDA, DELEGATING TO THE COUNTY <br /> ADMINISTRATOR OR DESIGNEE THE AUTHORITY TO <br /> EXECUTE STANDARD EXTENSIONS FOR BOTH <br /> CONTRACTS FOR CONSTRUCTION OF REQUIRED <br /> IMPROVEMENTS AND ACCOMPANYING CASH <br /> DEPOSIT AND ESCROW AGREEMENTS,IF APPLICABLE, <br /> UNDER SECTION 312.11 OF THE CODE OF INDIAN RIVER <br /> COUNTY; PROVIDING FOR AN EFFECTIVE DATE. <br /> WHEREAS, on February 10, 2009, the Indian River County Board of County <br /> Commissioners adopted Resolution 2009-008, which granted the County Administrator or <br /> designee the authority to execute standard Contracts for Construction of Required Roadway <br /> Improvements so long as the approval signature of the Public Works Director or designee appeared <br /> on the document; and <br /> WHEREAS,under Resolution 2009-008, when cash is posted, the County Administrator <br /> or designee was granted the authority to execute the standard Cash Deposit and Escrow Agreement <br /> so long as that document bears the approval signatures of the County Attorney or designee and the <br /> Budget Director or designee; and <br /> WHEREAS,there are times when the applicant working in the right-of-way is unable to <br /> complete the right-of-way improvements within the timeframe set forth in the Contract for <br /> Construction of Required Roadway Improvements; and <br /> WHEREAS, it is in the best interests of Indian River County and the public to be able to <br /> extend such Contracts for Construction of Required Roadway Improvements in an expeditious <br /> manner; and <br /> WHEREAS, such extensions are administrative in nature and do not require the attention <br /> of the Indian River County Board of County Commissioners; and <br /> WHEREAS, section 101.05.1.q, of the Code of Indian River County allows the Indian <br /> River County Board of County Commissioners to authorize the County Administrator,or designee, <br /> to perform other duties on behalf of the Board, <br /> NOW, THEREFORE, BE IT RESOLVED BY THE INDIAN RIVER COUNTY <br /> BOARD OF COUNTY COMMISSIONERS THAT: <br /> Section 1. The above "WHEREAS" clauses are true and correct, and hereby adopted as <br /> findings of this Board. <br /> Section 2. The County Administrator or designee is hereby delegated authority to execute <br /> extensions to standard Contracts for Construction of Required Roadway Improvements so long as <br /> the approval signature of the Public Works Director or designee appears on the document. <br />
