But basically under the agreement is, we <br />would come to some sort of understanding of what <br />Brightline will be building at their expense. <br />COMMISSIONER ZORC: So using 41st Street as an <br />example, turn lane, sidewalks, we would pay the additional <br />so we would have a formula to pay or would they include <br />those? <br />ATTORNEY REINGOLD: So generally what we're <br />looking at is for them to be... it's -- The negotiation is <br />still going back and forth. But what we would be looking <br />for is, <br />we would <br />like to have them <br />and I <br />believe they <br />would <br />agree to, <br />is that they would <br />build <br />the improvements <br />at the crossings that they've already agreed to under FRA; <br />they would then build the additional stuff we wanted them <br />to do, including sidewalks, and then that would all be at <br />their cost and from there on that would turn into <br />maintenance cost for us moving forward. <br />VERO BEACH COURT REPORTERS <br />772-231-2231 <br />4 <br />
