Assistant County Attorney Terry O'Brien counseled that the <br />letter was binding on the County and, if sent, should be reflective <br />of the Board's actual intent. <br />ON MOTION by Commissioner Bird, SECONDED by Commissioner <br />Eggert, the Board unanimously referred the matter for <br />consideration of the LAAC at the meeting to be held <br />_ February 22, 1995, and deferred action to the February <br />28, 1995, meeting. <br />INDIAN RIVER FARMS WATER CONTROL DISTRICT PERMIT AND <br />INTERLOCAL AGREEMENT <br />General Services Director Sonny Dean reviewed the Memorandum <br />dated February 13, 1995: <br />DATE: FEBRUARY 131 1995 <br />TO: HONORABLE BOARD OF COUNTY COMMISSIONERS <br />THRU: JAMES E. "SONNY" DEAN, DIRECTO <br />DEPARTMENT OF GENERAL SERVICES <br />BUWZCT: INDIAN RIVER FARMS WATER CONTROL DISTRICT <br />PERMIT AND INTERLOCAL AGREEMENT <br />BACKGROUND: <br />The Indian River Farms Water Control District, (IRFWCD) has <br />submitted a formal agreement with the County governing use of their <br />right-of-way for the underground fiber optic cable that provides <br />communications between the jail, administration building, and new <br />courthouse. The agreement is for one year and calls for a annual <br />cost of $2,076.00. <br />ANALYSIS: <br />Since this agreement has never been discussed with staff, this <br />writer called and talked with John Amos of the IRFWCD to ascertain <br />how the fee was determined and if it could be negotiated. Mr. Amos <br />advised that his Board had set this maintenance fee based on $1,200 <br />per mile right-of-way usage and all entities using their property <br />were being -charged accordingly. <br />RECOMMENDATIONS: <br />Based on the above and the fact that the cable is providing a very <br />useful service, staff recommends approval of the lease agreement. <br />33 <br />February 21, 1995 408 <br />
