Board of County Commissioners Meeting Minutes - Final October 1, 2019 <br />Commissioner Zorc stated that he had received a complaint regarding a four or <br />five hour delay from one of the current providers and agreed there was a need <br />for additional providers. <br />A motion was made by Commissioner Flescher, seconded by Commissioner <br />Zorc, to approve staffs recommendation. The motion carried by the following <br />vote: <br />Aye: 5 - Chairman Solari, Vice Chairman Adams, Commissioner Flescher, Commissioner <br />O'Bryan, and Commissioner Zorc <br />10. A.3.19-0905 Mark W. Plate's Request for Abandonment of a 130' Long Segment of the 70' <br />Wide 57th Avenue Right -of -Way South of 97th Place in the Tropicana <br />Homesites Subdivision, Plat Book 4 Page 20 [ROWA-18-07-03 / <br />2017030059-81633] (Legislative) <br />Recommended Action: Staff recommends that the Board abandon its rights to the subject right-of-way <br />and authorize the chairman to execute the proposed abandonment resolution, <br />with the following condition, as addressed in the proposed abandonment <br />resolution: A 10' foot wide drainage and utility easement shall be retained <br />along the south side of the subject right-of-way. <br />Attachments: Staff Report <br />Location Map <br />Abandonment Resolution <br />Through the use of a PowerPoint Presentation, John McCoy, Chief of Current <br />Development, indicated the designated area where Mark W. Plate requested the <br />abandonment of a right-of-way in the Tropicana Homesites Subdivision. Chief <br />McCoy explained that the Pelican Pointe Condominium Development (Pelican <br />Pointe) had expressed their concern regarding the proposed abandonment, since <br />they use the subject right-of-way to access their maintenance area. Chief <br />McCoy indicated that Mr. Plate and the Pelican Pointe Condominium <br />Development had reached an agreement to split the right-of-way which would <br />allow Pelican Pointe continual access to their maintenance area. <br />Chief McCoy pointed out that this abandonment was reviewed by all relevant <br />County divisions and utility providers having jurisdiction, with the following <br />conditions of approval: 1) to split the right -of way of abandonment, and 2) <br />retain public drainage and utility easement along the South 10' foot area of the <br />subject right-of-way. <br />The Chairman opened the Public Hearing. There being no speakers, the <br />Chairman closed the Public Hearing. <br />A motion was made by Commissioner Zorc, seconded by Vice Chairman Adams, <br />to approve Resolution 2019-090, providing for the closing, abandonment, <br />vacation and discontinuance of a 130' long segment of the 70' wide 57th Avenue <br />Indian River County Florida Page 9 <br />
