EXHIBIT 1) <br />LOCAL GOVERNMENT COOPERATIVE ASSISTANCE PROGRAM <br />MEMORANDUM OF AGREEMENT <br />BETWEEN <br />TILE STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION <br />AND <br />APPLICATION AGENCY INDIAN RIVER COUNTY <br />THIS MEMORANDUM OF AGREEMENT, made and entered into this 3 day <br />Of Marr.h , 1922_, by and between the STATE OI- FLORIDA DEPARTMENT <br />OF TRANSPORTATION, hereinafter referred to as the "DEPARTMENT", <br />AND <br />INDIAN RIVER COUNTY (local government entity), a body corporate and <br />politic and a political subdivision of the State of Florida, hereinafter referred to as the <br />"LOCAL GOVERNMENT". <br />W I T N E S S E T If: <br />WHEREAS, the DEPARTMENT has announced an anticipated appropriation of <br />matching funds for the Local Government Cooperative Assistance Program (Florida Statutes <br />335.20) for the upcoming fiscal year; and, <br />WHEREAS, the LOCAL GOVERNMENT desires to submit an application and apply <br />for such funds when they become available; and, <br />WHEREAS, the DEPARTMENT has indicated to the LOCAL GOVERNMENT and <br />the LOCAL GOVERNMENT acknowledges that the funding for the Local Government <br />Cooperative Assistance Program is contingent on legislative appropriation; and, <br />WHEREAS, the DEPARTMENT has indicated to the LOCAL GOVERNMENT and <br />the LOCAL GOVERNMENT acknowledges that ti►e DEPARTMENT will review, evaluate <br />and rank all project applications received and that project funding will be based on the rank <br />order listing of projects and the amount of available district appropriation allocation; and, <br />WHEREAS, the LOCAL, GOVERNMENTis qualified to participate in the Local <br />Government Cooperative Assistance Program and has complied with the requirements of <br />Chapter 335.20, Florida Statutes and Department of Transportation Rule Chapter 14-89, <br />Florida Administrative Code. <br />NOW THEREFORE: <br />
