Item of Payment <br />Payment for the work specified in this item shall be made under: <br />Bid Item No. 102-1 - Maintenance of Traffic - Per Lump Sum <br />SECTION 104 - PREVENTION, CONTROL, AND ABATEMENT OF EROSION AND <br />WATER POLLUTION <br />PART 1 —GENERAL <br />1.1 SCOPE <br />A. This. Section covers erosion control and the treatment of dewatering water and <br />stormwater runoff from the construction site and work area. Pollution control <br />measures shall prevent polluted or turbid waters from being discharged from the <br />construction site or work area to undeveloped portions of the site or offsite, including <br />but not limited to Multiple Separate Storm Sewer Systems (MS4s) and Waters of the <br />State. <br />B. The OWNER considers pollution from dewatering water and stormwater runoff from <br />a construction site or work area to be a very serious offense. The CONTRACTOR is <br />solely responsible for preventing pollution caused by dewatering water and <br />stormwater runoff from the construction site or work area. Note that state <br />regulations do not allow mixing stormwater and dewatering groundwater in the same <br />release — separate and independent discharges are required. <br />C. Pollution control measures specified herein represent minimum .standards to be <br />adhered to by the CONTRACTOR throughout the Project's construction. The <br />OWNER reserves the right to require the CONTRACTOR to employ additional <br />pollution control measures, when in the sole opinion of the OWNER, they are <br />warranted. If site specific conditions require additional erosion and stormwater <br />pollution control measures during any phase of construction or operation to prevent <br />erosion or to control sediment or other pollution, beyond those specified in the <br />Drawings, the Project's approved Stormwater Pollution Prevention Plan (SWPPP), <br />or herein, implement additional best management practices as necessary, in <br />accordance with Chapter 4, "Best Management Practices for Erosion and <br />Sedimentation Control" of the Florida Erosion and Sediment Control Inspector's <br />Manual and other references as may be applicable or required by regulatory <br />permits. <br />D. The OWNER may terminate this Contract if the CONTRACTOR fails to comply with <br />this Section. Alternatively, the OWNER may halt the CONTRACTOR's operations <br />until the CONTRACTOR is in full compliance with this Section.
