Please use caution when opening attachments or clicking links_;
Bill
There were no conclusive resolutions reached at the meeting, however it was an amiable meeting
and we believe good information was exchanged. Hawk's Nest now understands that CEMEX has no
current plans to expand its plant capacity, and that this rezoning effort was required, in part, by
elements of the plant being located on differently zoned parcels. We informed the Hawk's Nest reps
that the ERP held by CEMEX only allows it to fill the southern half of the sand -mine pit, a process
that will take place over the course of the coming several years and will result in an area in the north
of the sand -mine pit that provides an additional buffer to the golf course through distance and
natural vegetation. Hawk's Nest made it clear that their biggest concerns were any increase in
visibility, height and noise issues from the properties, and made a few requests for various ways to
mitigate their concerns. One request was for CEMEX to examine ways in which it might reduce
intermittent noise coming fromspecific activities at the plant. They also asked CEMEX to consider
Hawk's Nest's possible use of water from the sand mine pit for the golf course on an emergency
basis in the future, if Hawk's Nest deems it desirable and can obtain the requisite permits, etc.
Finally, Hawk's Nest requested whether a wind sock or flag could be mounted on the tallest plant
structure as an aid to golfers in wind direction. No specific action was promised or agreed to at the
meeting. CEMEX will discuss Hawk's Nest's various requests internally, and will respond in the
coming weeks.
Best Regards,
Bruce Barkett
<Bbarkett@verolaw.com>
130
Attachment 9
