BOOK 94 m,IL c <br />DESCRIPTION AND CONDITIONS: <br />Shady Oak Farms is a proposed 3 tract planned development <br />subdivision of a ±30 acre parcel of land located on the north side <br />of 17th Street S.W., halfway between 43rd Avenue and 58th Avenue. <br />The subject property is zoned A-1, Agricultural (up to 1 unit per <br />5 acres) and has a land use designation of AG -1, Agricultural (up <br />to 1 unit per 5 acres). <br />On December 8, 1994, the Planning and Zoning Commission granted <br />preliminary PD approval contingent upon special exception PD <br />approval. Such approval was granted by the Board of County <br />Commissioners at its regular meeting of January 10, 1995. The <br />applicant subsequently made all necessary improvements required by <br />Public Works for the PD. The developer, Charles and Gail Godwin, <br />through their agent Carter Associates, Inc., is now requesting <br />final plat approval -,.and has submitted the following: <br />1. A final plat in conformance with the approved preliminary <br />plat. <br />2. Documentation from the public works department that all <br />required improvements are complete. <br />ANALYSIS: <br />As an agricultural PD, the 10 acre tracts can be used for <br />residential or agricultural uses. Residential uses will be <br />restricted to 1 acre of the 10 acres. Thus, the PD plat meets the <br />special requirements for PD projects in agriculturally designated <br />areas (see attachment #4). <br />There were several minor improvements that were required by the <br />public works department in conjunction with this PD plat. These <br />improvements have been completed to the satisfaction of the public <br />works department. Therefore, all requirements for final PD plat <br />approval have been satisfied. <br />RECOMMENDATION: <br />Staff recommends that the Board of County Commissioners grant final <br />PD plat approval for Shady Oak Farms. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Adams, the Board unanimously granted <br />final PD plat approval to Agricultural Planned <br />Development known as Shady Oak Farms, as recommended <br />by staff. <br />E. Miscellaneous Budget Amendment 014 <br />Chairman Macht noted that the first three entries were deleted <br />at the request of Administrator Chandler. <br />The Board reviewed the following memo dated 3/22/95: <br />4 <br />MARCH 28, 1995 <br />
