Director Boling stated that is the type of issue staff is <br />addressing in the LDR amendments; such as options in lieu of <br />buffering, as different uses do have different types of <br />requirements. They would like to give some more flexibility in the <br />regulations. <br />Commissioner Bird inquired whether there was anyone from the <br />church at the meeting because he wanted to be sure they were aware <br />that the railroad crossing at 71st Street (Cemetery Road) might be <br />eliminated at some point in the future by Florida East Coast <br />Railway. 44th Court would remain as an access road, however. <br />Steve Cooper, of Mosby & Associates, the project engineer, was <br />not aware of the proposed closing. <br />Commissioner Adams inquired if the local neighbors had been <br />notified of the proposed uses and wanted to know if the school and <br />church were being used currently. <br />Director Boling responded that the church and the school are <br />presently operating out of the existing building but a new building <br />will be built for church use. <br />Commissioner Adams believed staff also needs to consider <br />buffers between compatible businesses, as cemeteries do lose <br />ownership or change. Commissioner Adams also inquired whether the <br />church and school have been ordered to cease and desist until the <br />permits have been taken care of. <br />Director Boling responded that code enforcement action <br />generally is to bring the entities into compliance and they are <br />usually allowed to proceed without code enforcement fines. <br />The Chairman opened the public hearing and asked if anyone <br />wished to be heard in this matter. -There being none, he closed the <br />public hearing. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Tippin, the Board unanimously granted <br />the special exception use requests for the place of <br />worship and the school with two conditions: 1) <br />prior to site plan release, the applicant revises <br />the site plan to depict the Type "C" buffer along <br />the south and west property lines; and 2) the <br />applicant grants a 5 foot wide drainage and utility <br />easement along the project's 71st Street frontage, <br />as recommended by.staff. <br />BOOK 94 PALUE 1 <br />APRIL 49 1995 31 <br />
