Obligations Relating <br />County to notify FCT <br />that may affect State <br />with respect to legal <br />to the Use of Bond Proceeds requires the <br />if any use of project property is proposed <br />bond proceeds used in acquiring the property, <br />and tax consequences. <br />Disallowable Activities/Remedies provides that the County will <br />cease any "disallowable activities" on the project property upon <br />written notification from the FCT, as applicable, and that the FCT <br />will be held harmless from all claims relating to disallowable <br />activities. "Disallowable activities" are specifically listed in <br />the Agreement, and include the operation of concessions on the <br />property, and "any use of the project site by any person other than <br />in such person's capacity as a member of the general public". <br />Site Specific Management Plan Conditions reflect information <br />presented to FCT in the County's grant applications, plus revisions <br />deemed appropriate by the FCT, relating to proposed site <br />improvements and use. Proposed improvements include nature trails, <br />a picnic area, information kiosk, gazebo, and limited parking. <br />Management of scrub habitat is also a described management plan <br />condition for the project. <br />RECOMMENDATION <br />Staff recommends that the Board of County Commissioners authorize <br />the Board Chairman to execute the attached Conceptual Approval <br />Agreement, and authorize staff to contact the City of Sebastian to <br />request its execution of the agreement. Staff also recommends that <br />the Board opt to have the County be the responsible party for <br />negotiation and acquisition activities associated with the <br />Sebastian Highlands scrub project. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Tippin, the Board unanimously approved <br />the Conceptual Approval Agreement, as set out in the <br />above staff recommendation. <br />AGREEMENT IS ON FILE IN THE OFFICE OF THE CLERK TO THE BOARD <br />H.
