BOOK 94 F}v,A91 <br />In their meetings with county staff, DeBartolo officials have said <br />that projected mall costs appear to be too high to allow the <br />corporation's board to approve construction of the project for a <br />Fall 1996 opening. To reduce DeBartolo's costs and enhance the <br />prospects of project construction being initiated in 1995, <br />DeBartolo has requested that, to make the project's "numbers" <br />better, the county take two principal actions. These are: <br />1. To collect water, sewer, and traffic "impact fees" from mall <br />tenants and provide those fees to DeBartolo to reimburse <br />DeBartolo for impact fees it has already paid or that will be <br />credited to DeBartolo for off-site road improvements; <br />and <br />2. To provide a cash contribution or reimbursement to DeBartolo <br />of up to $1.1 million to pay for the difference between <br />DeBartolo's estimates of off-site road improvement costs and <br />the actual project traffic impact fee (TIF) assessment. <br />Along with these two major requests, DeBartolo submitted a Notice <br />of Proposed Change (D.O. amendment) request to county staff on <br />March 29, 1995, and also submitted three draft developers <br />agreements to staff on March 31, 1995. The NOPC proposes to insert <br />into the D.O. specific county and developer responsibilities <br />relating to required traffic improvements.. The three draft <br />developers agreements address the NOPC issues and other topics, and <br />cover: <br />•Transportation Impact Fees and Credits <br />*Construction of Utilities <br />•Local Development Issues. <br />•TIMING FOR REVIEW OF REQUESTS <br />Since DeBartolo submitted all of the aforementioned requests in the <br />past two weeks, staff has discussed timeframes with DeBartolo <br />officials and has agreed to a review schedule. This schedule is as <br />follows: <br />• NOPC: The notice of proposed change to the D.O. must follow <br />a specified DRI amendment process including review by the <br />Treasure Coast Regional Planning Council, DCA, the Planning <br />and Zoning Commission, and consideration by the Board at an <br />advertised public hearing. Given those requirements, staff <br />anticipates Planning and Zoning Commission review in May and <br />Board consideration in May or June. <br />Developers Agreements: As submitted, the three developers <br />agreements are rough drafts, do not yet contain complete <br />information and back-up, and contain a number of details <br />relating to other agencies such as FDOT and the Indian River <br />Farms Water Control District. Since March 31st, staff and <br />DeBartolo representatives have worked together on completing <br />workable agreements and revising the drafts. However, these <br />agreements involve policy issues and many details, and must be <br />made complete prior to Board consideration. In addition, the <br />agreements cover some issues addressed in the NOPC. <br />Therefore, to allow time for the developer and staff to <br />complete the agreements, and to coordinate the timing of <br />agreement approval with the NOPC, staff will present the <br />agreements to the. Board at the time the Board considers the <br />NOPC. <br />34 <br />APRIL 18, 1995 <br />
