STREET LIGHTING AGREEMENT <br />• <br />Ty IS AGR.EEMENT, is entered into this -3-� day of <br />AIR , 1995, by and between Indian River County, a political <br />"su v on o the State of Florida, whose mailing address is 1840 25th <br />Street, Vero Beach, Florida 32960, hereinafter referred to as "COUNTY", <br />and JOHN'S ISLAND CLUB, INC., whose mailing address is 350 Beach Road, <br />Vero Beach, Florida 32963, hereinafter referred to as "CUSTOMER". <br />THIS AGREEMENT, is entered Into for the purpose of obtaining for <br />CUSTOMER necessary electrical energy and street lighting systems from the <br />Florida Power. a& Light Company, hereinafter "COMPANY", and incorporates <br />by reference all the terms, conditions and rates as set out in the <br />Conservation Lighting Conversion Agreement between COUNTY and COMPANY <br />as executed on January 6, 1965 and November 18, 1981, respectively. <br />COUNTY and CUSTOMER, in consideration of payments and <br />selrvices hereinafter mentioned, agree and covenant as follows: <br />1. COUNTY shall file with the COMPANY a "Request for Addition <br />of Facilities" (Exhibit C to the Conservation Lighting Conversion Agreement) <br />to provide the CUSTOMER with the following facilities: <br />One street light at the 55th Avenue and 87th Street <br />Intersection entrance to John's Island West Golf Club <br />2. CUSTOMER shall pay to the COUNTY for costs incurred by <br />the COUNTY under the terms ,of the Conservation Lighting Conversion <br />Agreement with COMPANY, and in consideration of administrative costs to <br />the COUNTY, the following: <br />$180.00 per year, in advance for the cost of <br />one (1) street lights <br />3. • CUSTOMER shall make payments to the' COUNTY, on an <br />annual basis, in advance, commencing on the date set forth herein, and <br />costs shall be subject to modification pursuant to any successive rate <br />schedules as may be approved by COMPANY from time to time. <br />4. The term of this agreement shall be until November 18, 1996 <br />and shall be renewed automatically for successive periods of five years, <br />unless COUNTY gives written notice to CUSTOMER of its intent not to renew <br />prior to the expiration of the initial term or any extension thereof, or, <br />unless CUSTOMER gives COUNTY notice of its intent to terminate six months <br />prior to expiration of the initial term or any extension thereof. <br />IN WITNESS WHEREOF, the parties have executed or caused this <br />agreement to be executed by their duly authorized officials on the date first <br />above written. <br />BOARD OF COUNTY COMMISSIONERS <br />INDIAN RIVER COUNTY, FLORIDA <br />By <br />Ja es E.
