11• <br />dedicated easement area, Service Company will not be required <br />to move or relocate any facilities lying outside a dedicated <br />easement area, so long as the facili <br />proposed ties do not interfere with <br />the then or use of the area in which the facilities <br />have been installed, and so long as ServiceCompany obtains, a <br />private easement for such facility location, which Coralstone <br />Will give if same is within his reasonable power to do so. Service Company agrees that once <br />service to the Property and Coralstone,it provides <br />Company will continuothereafter Service <br />usly provide, that at its cost and expense, but <br />in accordance with the other provisions of this Agreement, <br />including rules and regulations and rate schedules, Service to <br />the Property in a manner to conform with all requirements of <br />the applicable governmental authority having jurisdiction over <br />the operations of Service Company. <br />In order to avoid over building of excess capacity and <br />non -used and useful sewage collection treatment and disposal <br />facilities, Coralstone agrees that Service <br />have built capacity to fully serve the total mpneedsneof all <br />developments it . contracted to serve. <br />agrees, however, that when the eotmeny <br />volume of its sewagetre <br />and disposal facilities reaches 70 percent of existing <br />capacity, and provided that Coralstone has given Service <br />Company proper Notice to Proceed, indicating its intent to <br />expand development of <br />dits property, it will begin and <br />diligently pursue engineeringand permitting <br />plant and equipment in orderto <br />needs. Service toaccomodateo Coralstone'�s <br />Company further agrees that <br />reaches 80 percent of capacity, it <br />such additional plant and equiwill begin construction of <br />when such volume <br />pment and Complete such <br />construction prior to reaching 100 percent of capacity. <br />Failure of Service Company to meet the provisions of this <br />paragraph shall be deemed cause for Coralstone to sec <br />9 <br />
