CANCELLED OR INVALID TEST <br /> A drug test that has been declared invalid by the MRO or canceled for other reasons will be <br /> considered neither positive nor negative. A rejected sample by the lab is treated the same as a <br /> canceled test. For alcohol testing,a test that is deemed to be invalid per 40 CFR Part 40.267, <br /> will be considered neither negative nor positive. If a pre-employment drug test is canceled, <br /> the Designated Employer Representative(DER)will require the applicant to take another pre- <br /> employment drug test with a verified negative result before the individual can perform any <br /> safety-sensitive function. <br /> SPECIMEN TEMPERATURE OUT OF RANGE <br /> During the urine collection process,the urine specimen will be examined to determine if it has <br /> been altered or substituted. Any urine specimen with a temperature outside the range specified <br /> in 49 CFR Part 49 will result in a second collection under direct observation. <br /> ADDITIONAL TESTING/SPLIT-SPECIMEN <br /> An employee is entitled to request within 72 hours of learning of a verified positive test result <br /> by the MRO, for an additional test of the split specimen,at the employee's expense. A <br /> different DHHS-certified lab must be used,and the test will be conducted following 49 CFR <br /> Part 40 requirements. If the test result of the split-specimen fails to reconfirm the presence of a <br /> substance,the test result will be ruled,"Canceled", and procedures for canceled tests;49 CFR <br /> Part 40.187 will be followed. If the test result confirms"Positive",the test result is ruled <br /> positive. <br /> If the employee has not requested a split specimen test within 72 hours,the employee may <br /> present reasons why they were unable to make a timely request. The MRO will determine <br /> whether the explanation is satisfactory. <br /> Dilute Test <br /> SRA shall,upon receipt of a negative dilute result from the MRO,request the <br /> employee/applicant to submit to a second urine collection as outlined in 40 CFR Part <br /> 40.197. A verified,positive dilute constitutes the same as a verified positive non-dilute <br /> result. <br /> VERIFIED POSITIVE TEST RESULT PROCESS <br /> SRA will notify a covered employee of a random,reasonable suspicion and post-accident test <br /> result for controlled substances or alcohol conducted under this part when the test result is <br /> verified positive. SRA will inform the employee which substances were verified as positive. <br /> Under this policy,verified positive test results will result in removal from safety sensitive duty <br /> and termination from the organization. A referral to a DOT Certified Substance Abuse <br /> Professional who meets the qualifications outlined in 49 CFR Part 40.281 Subpart 0,will be <br /> provided to the employee. <br /> TREATMENT <br /> Covered employees who are in violation of this policy will be immediately removed from <br /> safety-sensitive duty and their employment will be terminated. Those that test positive are <br /> encouraged to make use of the available resources for treatment for alcohol and substance abuse <br /> programs. SRA will refer the terminated employee to a SAP who has knowledge of and clinical <br /> experience in the diagnosis and treatment for alcohol and controlled substances-related <br /> disorders,and who meets the qualifications outlined in 49 CFR Part 40.281 Subpart O. <br /> 131 <br />
