9. SRA may disclose information required to be maintained under 49 CFR part 655.73 <br /> pertaining to an employee/applicant,a decision maker in a lawsuit,grievance or other <br /> proceedings initiated by/on behalf of such individuals,and/or arising from the results of <br /> an alcohol and/or controlled substance test administered under this part,or from <br /> determination that the employee engaged in conduct prohibited by this policy, including <br /> but not limited a worker's compensation or other proceedings relating to a benefit sought <br /> by the employee. <br /> 10. SRA shall make available copies of test results conducted under this policy, including the <br /> administration of a post-accident alcohol and/or controlled substance test,or other <br /> information pertaining to alcohol misuse and/or controlled substance use prevention <br /> program,when requested by DOT,FTA or National Transportation Safety Board. <br /> SHY BLADDER <br /> If an employee is unable to produce sufficient urine for testing(shy bladder)he/she will be <br /> given up to three hours to produce a sufficient urine specimen for a drug test. During the <br /> three-hour period an employee will be given up to 40 ounces of fluid before making a <br /> second attempt to provide a complete specimen. <br /> CONSEQUENCES <br /> A covered employee will be immediately removed from their safety sensitive function, <br /> terminated from the organization,and referred to the SAP if any of the following occur: <br /> ❑ a verified positive drug test result <br /> ❑ a confirmed alcohol test result with an alcohol concentration of 0.04 or greater <br /> ❑ refusal of a request for testing <br /> REFUSAL TO TEST <br /> The following actions constitute a refusal to test: <br /> ❑ failure to sign the certification at Step 2 of the ATF for alcohol testing <br /> ❑ failure to remain at the test site until the test process is complete <br /> ❑ failure to undergo a medical examination or evaluation as directed by the MRO as <br /> part of the verification process <br /> ❑ if the MRO has verified an adulterated or substituted test result <br /> ❑ failure to provide a breath or urine specimen <br /> ❑ failure to provide a sufficient breath or urine sample without a valid medical explanation <br /> ❑ refusal to have the test directly observed or monitored or failure to permit the <br /> observation of monitoring of their specimen <br /> ❑ failure to take a second test the employer or the collector has directed <br /> ❑ failure to follow the observer's instructions during an observed collection including <br /> instructions to raise clothing above the waist, lower clothing and underpants,and to turn <br /> around to permit the observer to determine if there is present any type of prosthetic or <br /> other device that could be used to interfere with the collection process <br /> ❑ possess or wear a prosthetic or other device that could be used to interfere with the <br /> collection process <br /> ❑ admit to the collector or MRO that you adulterated or substituted the specimen <br /> ❑ verbal declaration of refusal,disruptive or uncooperative behavior,or failure to <br /> cooperate with any part of the testing process <br /> 130 <br />
