3/90(WCORD2)LEGAL(WGC/nhm) <br />RESOLUTION NO. 90-43 <br />A RESOLUTION OF THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, <br />FLORIDA, SETTING A DEFINITE TIME AND <br />PLACE FOR A PUBLIC HEARING TO CONSIDER <br />THE ADVISABILITY OF RENOUNCING AND <br />DISCLAIMING ANY RIGHT OF THE COUNTY AND <br />THE PUBLIC IN AND TO THE LAND DESCRIBED <br />AND MAPPED AS A "PUBLIC STREET", <br />PURSUANT TO THE AUTHORITY OF FLORIDA <br />STATUTE 336.09(1)(c). <br />WHEREAS, the Board of County Commissioners of <br />Indian River County have been petitioned by David Albrecht, <br />Esq. on behalf of Mr. and Mrs. Lee H. Hudgins to renounce <br />and disclaim any right of Indian River County and the public <br />In and to the following described property: <br />The West 35 feet of the following <br />described property: <br />Commencing at the Southwest corner of <br />Lot 7 of Sun Acres Subdivision as shown <br />on a plat thereof filed in the office of <br />the Clerk of the Circuit Court of Indian <br />River County, Florida, in Plat Book 5, <br />page 54, thence run West 25 feet; thence <br />run South 8 feet for the point of <br />beginning; from said point of beginning <br />run West 245 feet; thence run North 230 <br />feet, more or less, to the South <br />boundary of canal right-of-way; thence <br />run East 245 feet; thence run South 230 <br />feet, more or less, to the point of <br />beginning, as shown in Official Record <br />Book 101, page 387, public records of <br />Indian River County, Florida, being part <br />of Tract 10, less the East 15 feet of <br />the South 120 feet, Township 33 South, <br />Range 39 East. <br />and <br />WHEREAS, having considered the matter and advice <br />of staff, the Board finds it appropriate to schedule a <br />public hearing at a definite time and place to consider the <br />advisability of exercising the authority granted under <br />Florida Statute 336.09(1)(c) to renounce and disclaim any <br />right of the County and the public in and to the land <br />described above. <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF <br />COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, that: <br />
