No. 90 - <br />WHEREAS, any special assessment not paid within said <br />ninety (90) day period shall bear interest beyond the due date at <br />a rate established by the Board of County Commissioners at the <br />time of preparation of the final assessment roll, and shall be <br />payable in two (2) equal installments, the first to be made <br />twelve (12) months from the due date and subsequent payments to <br />be due yearly; and <br />WHEREAS, after examination of the nature and <br />anticipated usage of the proposed improvements, the Board of <br />County Commissioners has determined that the following described <br />properties shall receive a direct and special benefit from these <br />improvement, to wit: <br />Lots 20 through 38, Block 2; Rivenbark Subdivision as <br />recorded in Plat Book 3 Page 28 of the Public Records <br />of Indian River County. <br />W k of N 3 of SW h of NW h, Section 12, Township 33, <br />Range 39. <br />SW h of SW $ of NW k Less S 35 FT & described in <br />Official Records Book 659, Page 1539, less additional <br />right-of-way described in Official Records Book 721, <br />Page 278, & also less a portion of S 3 of SW '. of NW $ <br />described as follows: commence at intersection of N <br />right-of-way line of 12th Street as it now exists & <br />Westerly right -of -Way line of Old Dixie Highway as it <br />now exists, thence Northwesterly along right-of-way <br />line of Old Dixie Highway 303.73 FT, to Point of <br />Beginning thence continue along right-of-way line <br />351.23 FT, thence W 303.53 FT, thence southeasterly <br />327.50 FT, thence E 103.73 FT, thence southeasterly <br />parallel with said right-of-way line of Old Dixie <br />Highway 22.89 FT, thence E 200.0 FT to Point of <br />Beginning. <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY <br />OF INDIAN RIVER COUNTY, FLORIDA, as follows: <br />1. The foregoing recitals are affirmed and ratified in <br />their entirety. <br />2. A project providing for paving and drainage <br />improvements to 12th Avenue from 12th Street to 14th Street in <br />Rivenbark Subdivision; heretofore designated as Public Works <br />Project No. 8821 is hereby approved subject to the terms outlined <br />above and all applicable requirements of Section 11-41, et seq. <br />2 <br />
