mobilization, then issue another Notice to <br />Proceed to go to the prefabrication phase. <br />Under discussion, Commissioner Eggert had trouble voting for <br />that motion because of uncertain costs and because we do not know <br />the cost for mobilization next year. <br />Chairman Macht felt it was a big risk for a substantial amount <br />of money if we lose the appeal. <br />Frank Zorc, 2044 DeLeon Avenue, Vero Beach, appreciated <br />Commissioner Tippin's remarks. He understood the $200,000 for <br />mobilization would have to be paid immediately. He hoped the Board <br />would not give the Notice to Proceed, but if they did, they should <br />get a better breakdown of the $200,000. He had stood before them <br />almost a year ago, expressed his concerns about the "experimental <br />animal", and begged them not to sign the contract. He cAlso was <br />concerned that no monies were to be set aside in case it had to be <br />removed. He felt the failure at Palm Beach presented an abundant <br />example of the uncertainty of success in this type of product. He <br />believed it was still too experimental and has decided to file the <br />appeal on behalf of himself and 200 others who signed his petition. <br />He thought a poll would result in 80% of the citizens against <br />spending.the money on the experimental reef. He asked that they <br />postpone any commitment until such a device has acquired a record <br />of positive success somewhere. He added that it was not easy to <br />fight the ferocious wrath of Mother Nature. <br />Commissioner Eggert asked Attorney Vitunac if a partial Notice <br />to Proceed could be contingent on waiting the time period for any <br />appeals that might be filed. <br />Commissioner Tippin asked if there was any time limit on the <br />appeals. <br />County Attorney Vitunac advised they could condition the vote <br />today to make it when the permits are finally issued, without <br />further- appeals available to a challenger, then the Notice to <br />Proceed is valid. Challengers would have 14 days to file against <br />the permit. <br />Director Davis explained the three scenarios available and the <br />attendant costs. <br />County Attorney Vitunac pointed out a 4th scenario suggested <br />by Commissioner Adams -- to give the Notice to Proceed but not <br />issue the notice to fabricate for 30 days. <br />51 <br />May 23, 1995 <br />BOOS 95 FALE 209 <br />
