Joel Koford, City Manager of Sebastian, presented Sebastian Is <br />request for a joint public hearing. <br />Commissioner Adams felt it would be beneficial to hold the <br />public hearing jointly, and she suggested it be held in the third <br />week of July. <br />Commissioner Eggert had no problem with holding it in <br />Sebastian, but remembered joint meetings in the past that were held <br />in Sebastian on controversial issues. <br />Commissioner Bird believed we have two different audiences who <br />could benefit from two separate meetings - the Sebastian residents <br />and current County Utilities customers. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Bird, the Board unanimously established <br />two separate public hearings, as recommended by <br />Administrator Chandler. <br />AMENDMENT TO UTILITY FRANCHISES BETWEEN THE COUNTY <br />AND CITY OF VERO BEACH REGARDING RE -USE WATER ON <br />SOUTH BEACH <br />The Board reviewed the following memo dated 5/31/95: <br />TO: Board of County Co issioners <br />FROM: CharlseP. Vitunac, Coun y Attorney <br />DATE: May 31, 1995 <br />RE: Amendment to Utility Franchises between the <br />County and City roe South Beach Re -Use Water <br />The City of Vero Beach is the utility provider for the South Beach area <br />under franchises given by the Board of County Commissioners sometime <br />ago. By the attached letter from the City Attorney's Office, the City <br />is requesting that the franchises be amended to clarify that the City <br />has the right to construct and operate a re -use water system as part of <br />its utility providing authority. <br />The Department of Utility Services and the County Attorney's Office <br />believe that the re -use of treated effluent is subsumed in the <br />definition of wastewater service; however, there is no harm in <br />clarifying that in the franchise agreement. The problem occurs with the <br />City's request that the 6% County franchise fee not be levied against <br />their re -use water charges. Since the franchise fee money does not <br />return to the utilities department, the utilities department expresses <br />no opinion on the City's proposal. <br />The Administrator's recommendation is attached to this item and staff <br />respectfully requests direction from the Board. <br />24 <br />June, 6 1995 <br />
