� r � <br />Chairman Macht asked that this item be moved up on the Agenda <br />to allow Vero Beach city officials to get back to their jobs. <br />Administrator Chandler stressed that this is a difficult <br />recommendation to make because we all have been subjected to <br />mandates. Our concern is the potential for setting a precedent. <br />Tom Nason, Vero Beach City Manager, recapped that we got into <br />this through a mandate of the DEP. This was further mandated by <br />the St. Johns River Water Management District with regard to deep <br />well injections. All they are asking is that the re -use water be <br />a part of the water system. Mr. Nason did not feel there is any <br />potential for setting a precedent. <br />Larry Braisted, City Attorney for Vero Beach, offered to <br />answer any technical questions on the legalities of the agreement. <br />OMB Director Joe Baird was concerned about setting a precedent <br />with other franchises in the County. <br />Dorothy Hudson, attorney representing the Moorings Property <br />Owners Association, urged the Board not to impose the 6% franchise <br />fee on re -use water. <br />Administrator Chandler stated that at the present time the <br />County does not have any customers paying a 6% franchise fee on <br />re -use water. <br />Commissioner Tippin thought the attorneys could get together <br />and come up with some wording that would not set a precedent. <br />Commissioner Bird agreed that we need to look at the total <br />picture and make a decision on whether imposing a 6% tax is the <br />proper thing to do. If we think that encouraging people to use <br />re -use water is the thing to do, then we should go ahead and not <br />impose the franchise fee. <br />Commissioner Adams thought we should do what we can to <br />encourage people to use re -use water. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Adams, the Board unanimously tabled <br />this item for two weeks for further recommendations <br />and a better definition of re -use water. <br />Marvin brook, vice president of the Moorings Property Owners <br />Association, advised that he has been working on this matter with <br />the City of Vero Beach for the last few years, and they want to be <br />treated just like anyone else.
