Book 95 ;0 <br />14. The developer's obligation to present to and obtain approval <br />from the Board of County Commissioners regarding project <br />signage. <br />15. The developer's obligations regarding stormwater system <br />access, stormwater system location, and parking lot <br />maintenance. <br />16. The developer's satisfaction of or method of satisfying.D.O. <br />requirements relating to management plans for hazardous <br />materials, wetland/littoral zones, and conservation area <br />habitat. <br />17. The developer's ability, under planning staff's interpretation <br />of LDR building height allowances, to exclude certain building <br />features (e.g. roof equipment, skylight and window structures) <br />from the county's 35' height limitation. <br />18. The developer's satisfaction of certain D.O. conditions <br />relating to police and fire protection services. <br />*Transportation Impact Fee and Credits Agreement <br />This agreement, pursuant to provisions of the county's traffic <br />impact fee ordinance (Chapter 953), grants a traffic impact fee <br />credit to the developer for widening SR 60 and improving the 66th <br />Avenue/26th Street intersection. The agreement provides for the <br />following: <br />1. Assessment of the Mall, for transportation impact fee <br />purposes, based upon gross leasable area (excludes mall <br />"concourse" and other common areas) and assessment of the <br />shopping center and peripheral development based upon gross <br />floor area. <br />2. Use of the traffic impact fee rate for large retail projects <br />for all uses and buildings within the project, with the <br />exception of the peripheral development. <br />3. The specific amount of traffic impact fee credit to be given <br />for the SR 60 and 66th Avenue/26th Street improvements, based <br />upon cost estimates and designs provided by the developer and <br />reviewed by public works staff. Also, the agreement allows <br />for adjustments, approved by the Public Works Director, after <br />actual construction costs are known. <br />4. A determination of initial concurrency vesting for traffic, <br />for a specific amount of commercial development. <br />5. An arrangement, approved in concept by the Board of County <br />Commissioners at its April 18, 1995 meeting, whereby the <br />county will collect "traffic impact fees" from tenants and <br />lesees and distribute said fees, minus an administrative <br />charge, to the developer. <br />Staff's review of these proposed agreements indicates that they are <br />consistent with the LDRs, the D.O., and previous county approvals <br />and policies. <br />RECOMMENDATION: <br />Staff recommends that the Board of County Commissioners approve the <br />three agreements and authorize the Chairman to execute each <br />agreement. <br />30 <br />June, 6 1995 <br />0 <br />
