Bom 95 mf 1 <br />Planning Director Stan Boling advised that the three <br />agreements before the Board this morning finalize and memorialize <br />the way the LDRs and the D. 0. conditions are applied to this <br />project. He didn't feel the Board would find many new issues in <br />any of these development agreements, but these agreements do <br />specify the details. Director Boling advised that for the record <br />he would be highlighting some of the changes included in the <br />additional backup material distributed before the beginning of <br />today's meeting. <br />Director Boling highlighted the following changes in the <br />proposed interlocal agreement: <br />C) Reclassification of State Road 60: The County has <br />determined that State Road ('IS.R.") 60 may be <br />• reclassified from a class III to class V roadway, and <br />accordingly the County agrees to not object to any <br />developer- initated petition to the Florida Department of <br />Transportation ("FDOT") and the Indian River County <br />Metropolitan Planning Organization ("MPO") to reclassify <br />such roadway as a Class V roadway. The County <br />acknowledges that upon reclassification of S.R. 60 as a <br />Class V*roadway, the Developer may be entitled to remove <br />median turning movement restrictions and to construct a <br />signal and provide full access turning movements at <br />entrance "D" to the Development, which entrance is <br />generally depicted on Revised Map H, attached to and <br />incorporated in the Development Order, subject to FDOT <br />access management approval and meeting applicable <br />warrants. <br />grading shall be established as part of site plan review for <br />the Mall and/br Shopping Center. Such initial selective <br />clearing, grubbing and grading shall not be considered <br />"development", and therefore such areas shall not at that time <br />be subject to buffering or other development conditions <br />associated with development of the Peripheral Development. <br />32 <br />June, 6 1995 <br />
