.13) On-site Storm Drainage System: <br />A) The County acknowledges that under applicable <br />regulations, the Development shall not be required to <br />provide public access to detention areas, retention <br />areas, wetlands, or wetland mitigation areas , and the <br />County will not request that any such public access be <br />provided; however, the Developer, shall provide emergency <br />maintenance access to such areas as shown on the approved <br />site plan. <br />B) The - Developer, at its option, may utilize the <br />residentially zoned portion of the Property for the <br />'- stormwater system of the Development, as reflected in a <br />letter from William G. Collins II dated August 2, 1990, <br />attached hereto and incorporated herein as Exhibit "B". <br />C) Pursuant to condition 24 of the Development Order, the <br />Developer shall be responsible for implementing -a parking <br />lot sweeping program for the Mall and Shopping Center. <br />The . Peripheral Development developer(s) shall be <br />responsible for implementing a parking lot sweeping <br />program in connection with development. of such Peripheral <br />Development, as required under the Development Order. <br />14) Management Plans: <br />A) The hazardous materials management plan required under <br />condition 26 of the Development Order has been provided <br />by'the Developer, and accordingly such condition to the <br />issuance of building permits has been satisfied. <br />B) The habitat management plan required under condition 19 <br />of the Development Order shall be' submitted by the <br />Developer for approval by the County and DCA, in <br />consultation with the TCRPC, prior to any clearing or <br />activity within the 4.7 acre cabbage palm hammock area. <br />15) Building Heights: <br />Under applicable Land Development Regulations, the <br />Development shall not exceed an average building height <br />of 35 feet as measured in accordance with applicable <br />County regulations. For* purposes of calculating maximum <br />heights of buildings, antennae, communication facilities, <br />e2cchan+cal equirnvnt, elr conditioning and condensing <br />units, roof structures for housing elevators, elevator <br />towers, and similar equipment, required to operate and <br />maintain buildings, architectural. features, such as <br />16) Fire Protection: <br />The County acknowledges that adequate fire <br />protection/emergency medical service is available to <br />serve the Development and that the Development has met <br />concurrency requirements for fire protection/emergency <br />medical service through buildout of the Development, as <br />evidenced by the letter dated May 1, 1995 from the Indian <br />River County Department of Emergency Services, attached <br />hereto and incorporated herein as Exhibit "C". <br />Accordingly, the Developer has satisfied condition 36 of <br />the Development Order. <br />33 <br />June, 6 1995 <br />BOR nzt <br />V_ <br />.�K <br />41 <br />
