stressed that the bank will not foreclose because they would be <br />responsible for the clean up and it is an enormous liability. <br />Administrator Chandler interjected that staff was trying to <br />find a way to clean up the property without taking title. <br />Attorney Collins added that we may take title to it anyway <br />because of the aging of the tax certificates and there's no state <br />money for remediation or clean up. The site had been slated for <br />clean-up, but the funds have dried up. <br />Chairman Macht figured that since we were going to own it <br />anyway, we have a responsibility to take careā¢of the eyesore. He <br />suggested removing it all and capping -the tanks. <br />Commissioner Bird disagreed and believed if the eyesore was <br />removed the tanks would also have to be removed, because the <br />liability would be -left under the ground and the surface scraped. <br />Attorney Collins requested, if the Board decided to go forward <br />with it, that the County Attorney's office be instructed to work <br />with the County Environmental Health Department in order to <br />minimize any exposure, since there would be some. <br />Commissioner Bird suggested an estimate be obtained from an <br />environmental cleanup company to do everything to get the property <br />in saleable condition. <br />Discussion ensued on the possibility of recovering costs from <br />sale of the property. County Attorney Vitunac recommended getting <br />a quit claim from the bank to get them out of the picture. <br />Public Works Director Jim Davis explained the procedure for <br />determining contamination which involves establishing monitoring <br />wells on the site. He cautioned if there was a contamination <br />flume, it could have encroached upon neighboring property. <br />MOTION AND SECOND WERE WITHDRAWN. <br />The Board reached CONSENSUS to table the item for two weeks <br />while staff obtained estimates from environmental cleanup companies <br />and investigate obtaining a quit claim deed. <br />Attorney Vitunac pointed out that relative to the tax lien <br />holders, the County's lien would be co -equal with their liens. He <br />also explained that a title search would have to be done and all <br />property interests would have to be determined before going. too <br />far. Although two weeks would not be long enough to accomplish <br />everything, they could get an idea. <br />The County Administrator was directed to bring it back when it <br />is ready. <br />39 <br />June 20, 1995 <br />
