RECOMMENDATION: <br />Staff recommends Alternative No. 1. <br />Staff further recommends that the Board of County Commissioners declare said structure a <br />nuisance, and order the -building demolished with related debris removed from the property by <br />the County Road and Bridge Department. <br />Staff also recommends that the Board adopt the attached Resolution authorizing the Building <br />Official to report the county's demolition and debris removal cost for the structure tothe <br />County Attorney for the preparation and recording of a lien to be placed on the real property <br />of the owner for the purpose of recovering the county's costs. <br />Bob Keating, Community Development Director, reviewed the <br />situation for the Board. <br />Charles Vogt, Environmentall-,Aiealth Department, advised that <br />there is no reason to suspect any contamination other than <br />petroleum but there could be pesticides as this is an agricultural <br />area. Mr. Vogt recommended that no action be taken at this time as <br />the County could be held liable for discharging additional <br />contamination. <br />County Attorney Vitunac advised that the County may own the <br />property in 7 years as a result of tax liens. Notice has been <br />given to the owner but it is his understanding that the corporation <br />is out of business. <br />Deputy County Attorney Collins stated that a title search <br />shows the property is owned by Larry Catron. However, Attorney <br />Collins has been told that Mr. Catron'filed for bankruptcy. There <br />are 2 mortgages and both banks filed suit on the promissory notes, <br />not for foreclosure of the mortgages. There are liens against the <br />property totaling $177,000 which are accruing interest. He <br />believed that the safest course would be to take no action at this <br />time. Tax certificates unpaid for 7 years, by operation of state <br />law, will title the land in the County for back taxes and he <br />believes the County would have a better chance at that time of <br />qualifying for funding of clean up. <br />Commissioner Bird advised he has been told there may be some <br />individual investors and requested a delay of one week to give the <br />County Attorney's Office time to contact these individuals and <br />ascertain what their position would be. <br />MOTION WAS MADE by Commissioner Adams, SECONDED by <br />Commissioner Eggert, that the Board approve <br />Alternate No. 1 to proceed with demolition, as <br />recommended by staff. <br />Bou 95 FACF669 <br />JULY 119 1995 25 <br />
