Collins II - Deputy County Attorney <br />DATE: June 22, 1995 <br />SUBJECT: Professional Services Advisory Committee Recommendation <br />Re: Timing of Utility Impact Fee Payments <br />The Professional Services Advisory Committee has recommended that Section <br />201.09 . A regarding the time an impact fee is imposed should be revised. <br />The Committee felt that payment of utility impact fees should be consistent <br />with traffic impact fees, i.e., the developer should be able to elect to take a <br />risk that capacity will be available at a later date by not reserving capacity <br />prior to final development approvals. <br />Below is the suggested revision: <br />Section 201.09.Impact fees. <br />A. Impact fee imposed. An impact fee shall be imposed <br />on each ERU responsible for creating the need for <br />additional system expansion based on the equitable <br />portion of the cost of funding the 0*10400:4 expansion of <br />the county's sewer and water systems.
