Commissioner Bird questioned going east of the existing <br />commercial industrial developments, rather than west. <br />Commissioner Adams pointed out the road, water and sewer were <br />already in place. <br />Darrell Fennell, attorney representing Tom Hamilton as <br />Personal Representative of Estate of Carlson Plat, which owns <br />approximately 300 acres west of the current node, who only became <br />aware of this proposal this morning and wanted to express a concern <br />on behalf of the Estate. He explained his understanding of what <br />was potentially occurring and advised of the desire of the Estate <br />to work with the County. He advised the property is for sale and <br />concurred with Commissioner Bird's remarks. <br />Commissioner Eggert explained the intent was not to expand the <br />node, but there was some environmentally sensitive land that could <br />be used for storm water and the designation commercial/industrial <br />could be taken off that and placed elsewhere. <br />Commissioner Adams responded that the County had no plans to <br />develop the property now; we are merely trying to take advantage of <br />a situation being offered. Perhaps that property would be <br />privately developed, which obviously would enhance the value of the <br />Estate's property. She would look forward to his input down the <br />road on what will be done with the property. <br />Attorney Fennell asked if she was saying that it may be that <br />even though there would be a discussion with the Estate regarding <br />the elimination of the acres in the borrow pit area, that would not <br />necessarily remove the opportunity to use that by the estate. <br />Commissioners Eggert and Adams responded in the affirmative. <br />Dean Leuthje, engineer with Carter Associates, who accompanied <br />Attorney Fennell, addressed the mitigation possibilities for <br />wetlands on the 395 acres owned by the Estate. He would not wish <br />to see the Estate penalized by saying that the wetlands that may or <br />may not be on the 300 acres within the node could not be developed, <br />because they could be developed through other kinds of mitigation. <br />He advised there was no offer pending on the property, but it was <br />for sale. <br />THE CHAIRMAN CALLED THE QUESTION and the <br />motion carried 4-1; Commissioner Bird was <br />opposed. <br />39 <br />August 8, 1995 <br />ODS( 95 fnE 887 <br />
