y <br />tIle <br />ug n g?F'kY„swy. :x fV +# ^,yn a,i{ Y,3, 3 E a 1Y X _ fr w , <br />4 <br />1i A <br />it must abut an arterial road that contains county water and sewer lines within the road ' s <br />right- of- way ; <br />it must abut corrunercial/industrial designated property ; and <br />it must be at least 20 acres in size . <br />Currently , there are ± 164 . 1 acres , in 3 separate tracts , in the county that meet the above criteria. <br />Additionally , the proposed amendment places the following special regulations on T designated land : <br />Caribbean Fruit Fly host plants are prohibited . <br />When platting lots in residential projects , the land owner must place a statement on the plat <br />and on the deed of each lot . That statement must inform the lot buyer of the Florida Right <br />to Farm Act , and that active farm operations occur nearby . <br />BACKGROUND <br />On July 11 , 2000 , the Board of County Commissioners considered a request by Gerald Clontz to <br />amend the comprehensive plan future land use map designation of his property from AG- 1 , <br />Agricultural - 1 ( up to 1 rmit/5 acres ) , to M- 1 , Medium- Density Residential- 1 ( up to 8 units/acre) ; and <br />to expand the urban service area to include his property . Although the Board denied the request by <br />a 5 to 0 vote , the Board indicated a desire to "find some relief for Mr . Clontz . " The Board also <br />acknowledged that, because the circumstances affecting the Clontz property were similar to the <br />circumstances affecting many other properties in the county , action taken on the Clontz property <br />would have countywide implications . For those reasons , the Board instructed staff to continue to <br />study the issue and present alternatives to the Board . Those alternatives were presented to the Board <br />and discussed at a special workshop meeting held on October 9 , 2000 . <br />At the October 9" workshop , staff presented several land use and urban service area alternatives . <br />In addition to staff' s alternatives , Mr. Clontz ' s attorney , Michael O ' Haire , presented a proposal to <br />the Board for creating a " transitional " area for land meeting certain criteria. Attachment 2 is the <br />specific proposal presented by Mr. O ' Haire . By increasing the number of residential units that could <br />be built on property that meets certain criteria, Mr. O ' Haire ' s proposal gave relief to Mr . Clontz . <br />Specifically , the proposal was to establish a new "T , Transitional Residential" land use designation <br />for property that meets the following criteria : <br />1 ) The property is currently designated AG- 1 ; <br />2 ) The property abuts the urban service area ; <br />3 ) The property abuts a commercial/industrial node ; <br />4) The property fronts on an arterial road ; <br />5 ) Utility lines for both water and sewer are available at the property boundary ; and <br />6) The property is at least 20 acres in size . <br />As presented, Mr . O ' Haire ' s proposed land use designation would have allowed land to be rezoned <br />to a zoning district that permits densities of up to 1 unit/acre or, if developed as a Planned <br />Development ( PD ) , up to 3 units/acre . Mr. O ' Haire ' s proposal also included expanding the urban <br />service area to include T designated land . <br />Recognizing that such a proposal needed technical analysis , the Board instructed staff to review , <br />analyze , and " clean- up " the proposal ; and report back to the Board . <br />October 16 , 2001 <br />95 <br />t i <br />it) or <br />3 6 Lie <br />4 <br />IIJ <br />x o
