16 <br />26 wS e <br />s s <br />As instructed , staff reported to the Board at the December 12 , 2000 , Board of County Commissioners <br />Meeting . At that meeting , staff presented several alternatives to the Board. After much discussion , <br />the Board directed staff to process a county initiated text amendment and a county initiated future <br />land use map amendment for the January 2001 Plan Amendment Submittal Window . Additionally , <br />the Board told staff that those amendments were to implement Mr . O ' Haire7s proposal . The Board, <br />however, stated that it did not wish to preclude the Planning and Zoning Commission from <br />considering any alternatives , and that the Board would consider any alternatives recommended by <br />the Planning and Zoning Commission . <br />PLANNING AND ZONING COMMISSION ACTION <br />On April 5 , 2001 , the Planning and Zoning Commission (PZC ) considered this item at a public <br />hearing .At that meeting , several alternatives were presented to the PZC .Although all seven <br />members of the Commission were present, two members filed Conflict of Interest forms because <br />those members have interests in property affected by the item. As a result of the conflicts , the two <br />affected members could participate in the discussion , but could not vote on this item . <br />Regarding this item, two motions were made at the Planning and Zoning Commission meeting . The <br />first motion was to recommend that the Board of County Commissioners adopt the O ' Haire <br />Proposal , with the following three additions : <br />prohibition of Caribbean Fruit Fly host plants ; <br />required notification of the Florida Right to Farm Act ; and <br />150 foot wide buffers . <br />That motion failed on a 2 to 3 vote . <br />The second motion was to recommend that the Board of County Cominissioners delay any decision <br />on this , while continuing to study other alternatives , including the alternative of concentrating <br />development around rural villages . The Planning and Zoning Commission voted 3 to 2 to in favor <br />of the second motion . <br />Although a majority of Planning and Zoning Commissioners eligible to vote voted in favor of the <br />motion , Section 103 . 02 . 12 of the County Code of Laws and Ordinances states that any matter or <br />application considered by a board or commission with more than five members must receive four <br />or more votes for passage . Since the Planning and Zoning Commission has seven members and the <br />subject motion received only three affirmative votes , the favorable recommendation technically <br />failed. <br />PROFESSIONAL SERVICES ADVISORY COMMITTEE ACTION <br />On May 17 , 2001 , the Professional Services Advisory Committee (PS AC) considered the proposed <br />amendment and several other alternatives . At that meeting the PSAC voted 9 to 0 to recommend that <br />the Board of County Commissioners choose one of the other alternatives . <br />TRANSMITTAL HEARING <br />On June 5 , 2001 , the Board of County Commissioners considered several alternatives for transmittal <br />to the Florida Department of Community Affairs (DCA) for their review .
