J 1,}h,..c3 o =S x, er "'q.G x .r- <br />r, k Jr. : 2 .3 t wY <br />ORC REPORT <br />Consistent with state regulations , DCA reviewed the proposed amendment and prepared an <br />Objections , Recommendations and Comments ( ORC ) Report (dated August 17 , 2001 ) , which <br />planning staff received on August 20, 2001 . The DCA ORC Report, Attachment 7 at the end of this <br />staff report, does not contain any objections or comments relating to the proposed amendment . <br />ANALYSIS <br />This section includes an analysis of the proposed amendment. This section also includes a <br />discussion of the amendment ' s consistency with the comprehensive plan . <br />REASONABLENESS OF THE PROPOSED AMENDMENT <br />By creating an urban land use designation that is narrowly structured to include only a few <br />properties , the proposed amendment allows the county to provide relief for Mr. Clontz without <br />encouraging urban sprawl or allowing the large scale conversion of agricultural land to suburban <br />land . <br />As structured, the proposed amendment contains certain provisions that will increase compatibility <br />between AG - 1 designated and T designated land. Two of those provisions are the prohibition of <br />Caribbean Fruit Fly host plants on T designated land , and the requirement that buyers of T <br />designated platted lots be provided notification of the Florida Right to Farm Act and of the existence <br />of agricultural activities occurring nearby . <br />Another provision that will increase compatibility between AG- I designated and T designated land <br />is the incentive to use the PD process when developing T designated land (PD development in T <br />designated areas may occur at a 3 units/acre density compared to the 1 unit/acre density allowed by <br />non- PD development) . With the PD process , the Board has the right to require site design elements <br />that mitigate impacts . Those elements can include berms , buffers , fences , and the siting of buildings , <br />storm water management areas , and open space . <br />Additionally , the limited urban service area expansion associated with the proposed amendment <br />allows the county to continue to study other altematives . <br />As structured , the proposed amendment provides relief for Mr . Clontz , does not encourage urban <br />sprawl , does not increase incompatibilities , and allows further study and/or actions to address the <br />problem of development at the edge of the urban service area . For those reasons , the proposed <br />amendment is reasonable . <br />CONSISTENCY WITH THE COMPREHENSIVE PLAN <br />Staff reviews each comprehensive plan amendment request for consistency with all applicable <br />policies of the comprehensive plan . As per Section 800 . 07 ( 1 ) of the county code , the <br />comprehensive plan may only be amended in such a way as to preserve the internal consistency of <br />the plan pursuant to Section 163 . 3177 ( 2 ) F . S . " <br />The goals , objectives and policies are the most important parts of the comprehensive plan . Policies <br />are statements in the plan which identify the actions which the county will take in order to direct the <br />community ' s development .
