McCoy, AICP o\ <br />Senior Planner, Current Development <br />DATE: September 11, 1995 <br />SUBJECT: New Hope Ministries Request to Modify Buffers <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at its regular <br />meeting of September 19, 1995. <br />DESCRIPTION AND CONDITIONS: <br />At its April 4, 1995 meeting, the Board of County Commissioners <br />granted conditional special exception use approval to New Hope <br />Ministries for a private school and place of worship. The subject <br />property is located on the south side of Cemetery Road <br />approximately 1,800' west of Old Dixie Highway. The Winter Beach <br />Cemetery is adjacent to the site on the south and west sides of the <br />subject site (see attachment #2). <br />At the time the application was approved, the LDRs required a Type <br />"C" buffer to be constructed between the proposed school and church <br />facilities and abutting residentially zoned property, which <br />includes the Winter Beach Cemetery property. Although the <br />submitted site plan did not depict such buffers, the project site <br />plan application was approved with the following condition: <br />"The applicant shall revise the site plan to depict the <br />Type "C" buffer along the south. and west property lines. <br />In the future, the approved site plan and buffers may be <br />modified in accordance with the approved LDR buffer <br />modifications." <br />Subsequent to the conditional special exception approval, the Board <br />of County Commissioners approved an LDR amendment which gives the <br />Board the authority to waive the Type C buffer requirement. <br />The applicant is now requesting that the Board of County <br />Commissioners modify the special exception approval to waive the <br />Type "C" buffer requirement along the south and west sides of the <br />project, where the site is adjacent to the Winter Beach Cemetery. <br />The Board of County Commissioners has the ability to waive the <br />requirement, retain the requirement, or modify the requirement to <br />a lesser requirement. <br />57 <br />September 19, 1995 <br />BOOK 96 PAGE 152 <br />
