BOOK 96 PACE 153 <br />ANALYSIS: <br />At its May 31, 1995 meeting the Board of County Commissioners <br />adopted revised LDRs, which allow the buffer requirements to be <br />waived or reduced where a school or place of worship is proposed <br />next to an existing cemetery, place of worship, child care <br />facility, community center or school (see attachment #4). The <br />amended LDRs allow the Board to reduce or waive the Type "C" buffer <br />requirement after considering the need for the buffer to mitigate <br />security, noise, and visual impacts. <br />The proposed school will serve approximately 35 students from <br />grades 1 through 12. The proposed church will accommodate 300 <br />people at buildout. On its south side, the subject site shares <br />360' of common border with the Winter Beach Cemetery. A dirt road <br />runs along the site's west property line (2901) and connects <br />Cemetery Road to 69th Street. Immediately west of this road is <br />another portion of the Winter Beach Cemetery. <br />In reviewing this request to waive the Type "C" buffer requirement, <br />staff gave consideration to security, noise, and visual impacts of <br />the project on the cemetery. In staff's opinion, the noise and <br />visual impacts of the school and church on the cemetery should not <br />be significant. All of the uses are institutional and involve <br />significant open space, and outdoor activities involving the church <br />or the school would be limited to certain times of the day. <br />However, staff believes that there could be security impacts from <br />the proposed school, since cemeteries can be attractions for school <br />age children. To help ensure that school children would not wander <br />onto or explore the cemetery, it is staff's opinion that a fence, <br />a minimum height of 4' , be constructed along the south and west <br />property lines of the project site. Such fencing would be'a clear <br />line of demarcation for the children and would provide a deterrent <br />to entering the cemetery grounds from the school site. <br />Therefore, it is staff's opinion that the Type "C" buffer could be <br />justifiably waived with a condition that a fence at least 4' high <br />be installed along the project's south and west property <br />boundaries. All other normal site plan landscaping requirements <br />would continue to apply, which would include the following <br />landscaping improvements along the project perimeters: <br />North: 10' landscape strip with hedge and 1 tree per 30' <br />South: 1 tree per 40' <br />East: Type "C" buffer <br />West: 1 tree per 40' plus a hedge where parking lot area is <br />adjacent to property line. <br />RECOMMENDATION: <br />Based on the above analysis, staff recommends that the Board of <br />County Commissioners waive the Type "C" buffer requirement subject <br />to the condition that along the site's south and west boundaries a <br />fence at least 4' in height shall be provided prior to issuance of <br />a Certificate of Occupancy (C.O.) for the school. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Tippin, the Board unanimously <br />approved staff's recommendation as set out in <br />the Memorandum. <br />58 - <br />September 19, 1995 <br />_I <br />
