Section t is amendcd to read: <br />"This Resolution shall be, known and may be cited <br />Lis 'the Subdivision Resolution of Indian River County, <br />Florida,' This Resolution regulates the Subdivision of <br />'idil,outside <br />lands ill tudiall River C(Alllty, U101 Which He <br />the territorial limits of any municipality. It is adopted <br />pursuant to the authority vested in this board by Chapter <br />29155, Laws of Florida, Acts of 1953, and it is applicable, <br />to any such lands comprising one acre or more which is <br />platted into lots, blocks, tracts, parcels or other portions <br />however designated so as to comprise three oi. - e <br />more to th <br />acre. In accordance with the provisions of that law, any <br />owner or owners of such lands is prohibited from dividing <br />such lands or selling the same by lots or units by metes <br />and bounds description in order to circumvent the Provi- <br />sions of that act and this Resolution; provided, however, <br />that any lands may be divided and sold in any manner if <br />after Such division all of the same border upon an existing <br />street or public road. In its intetprotation and application <br />the provisions of this Resolution shall be held to be the <br />minimurn requirements adopted for the protection of the <br />public health, safety and welfare. To protect the public, <br />among other purposes, these provisions are intended to <br />provide for permanently wholesome community environ- <br />ment, adequate services, proper drai nage and safe streets, <br />This Resolution shall not apply to any land forming a part of <br />a subdivision created and recorded prior to the original effec- <br />tive date of this Resolution but it shall apply to any resub- <br />dividing, and shall be effective for all subdivisions which do <br />not have preliminary approval, or final plat approval one <br />hundred and eighty days (180) from the date of adoption. <br />(See Section XII. ) It is not intended by this Resolution to <br />repeal, abrogate, annul or in any way impair or interfere <br />with existing provisions of other laws or resolutions 0XGePU <br />those specifically repealed by this Resolution, Or With Private <br />restrictions placed upon property by deed, covenant or other <br />private agreement or with restrictive covenants running with <br />the land to which the County is a party. Where this Resolution <br />imposes a greater restriction upon land than is imposed or <br />required by such existing provisions, the provisions of this <br />Resolution shall control. " <br />2. Section VII -15 is amended to read: <br />"Private streets are allowed, provided the County finds <br />that the same will not be required as public streets in the Over- <br />all County plan. 'I'liere shall be no maintenance or improve - <br />monts of private streets by the County.
