him does not sound like open space, if they were referring to green space in agriculture <br />areas. <br />Commissioner O'Bryan wanted to know from Council Members how <br />they would address some of that in these Developer Agreements. He believed that if the <br />County was to be part of the ILA, and wanted to move the Urban Service Line, and has to <br />go through Section 12 by unanimous agreement, then all cities should be bound by <br />Section 12, as is the County. <br />Suzanne Joyce, Vice Mayor, Town of Orchid addressed a question <br />brought up by Commissioner O'Bryan at the last meeting, and as shown at page 15 of the <br />backup, where it is stated that this agreement would terminate upon the appointment of a <br />Charter Commission either following the adoption of a resolution by the Board of County <br />Commissioners, et cetera. She understood from that language that everything is carved <br />out by a resolution by the Board of County Commissioners, and it is all gone. She <br />invited input on the issue. <br />Attorney Stringer disclosed that it is not an automatic termination, and he <br />explained the basis for the termination provision. <br />Attorney Warren Dill, City of Fellsmere, who has been involved in the <br />ISBA process, and helped write the document, pointed out that there are a lot of different <br />provisions in the document that look similar, but after reading them they are substantially <br />different. He addressed a comment that Fellsmere was not subject to restrictions on <br />annexation, and pointed out that Section 11 stipulates that any new annexation has to <br />comply with Section 12, unless the property contains the same or identical regulations as <br />the County. <br />27 <br />July 23, 2008 / Joint Workshop <br />ISBA, Sebastian <br />
