He remarked that if the New Town comes in and the Cities of Fellsmere and <br />Sebastian comply with the current County regulations, why then should they not be <br />exempt. <br />Attorney Stringer added that the County cannot do New Town <br />development without moving the Urban Service Line. Discussion ensued among <br />Commissioner O'Bryan and Attorneys Stringer and Dill regarding exemptions and <br />moving the Urban Service Line, and Commissioner O'Bryan felt if the County addresses <br />the" New Town" concept then Sebastian and Fellsmere should be willing to come in <br />under Section 12 and they would all be under equal footing. <br />City Manager Nunemaker thought, "regarding the poison pill provision," <br />they could compromise, to the extent the Charter pre-empts any Home Rule authority that <br />would be the kick -in procedure. Therefore, if they are able to work from that basis where <br />there is no pre-emption involved, then it would never come to bear, and that would give <br />more protection if any Charter issue comes up. <br />Attorney Stringer addressed Commissioner O'Bryan's concern regarding <br />Sebastian being exempt from Section 12.
