MITM, CLERK <br />(d) TENANT shall maintain the grounds, landscaping and parking areas in <br />keeping with the same standards under which the City of Vero Beach maintains the <br />Airport grounds, landscaping, and parking areas. <br />14. DEFAULT: <br />(a) Default in Payment of Rent. Should the TENANT fail to pay to the LANDLORD <br />any installment of rent when due, the TENANT shall be deemed in default of the Lease <br />Agreement and the TENANT shall either cure such default or surrender possession of <br />the Leased Premises to the LANDLORD within three (3) days after written notice of the <br />default is served on the TENANT. <br />(b) Defaults Other than Rent. Should the TENANT fail to perform or comply <br />with any of its obligations, covenants, conditions, agreements, or assurances, other <br />than payment of rent, the TENANT shall be deemed in default of the Lease Agreement <br />and the TENANT shall either cure such default or surrender possession of the Leased <br />Premises to the LANDLORD within fifteen (15) days after written notice of the default is <br />served on the TENANT. <br />(c) Abandonment. Should the TENANT abandon the Leased Premises, <br />whether such abandonment is actually known to the LANDLORD or presumed, the <br />TENANT shall be deemed in default of the Lease Agreement. Absent actual knowledge <br />by the LANDLORD of abandonment of the Leased Premises by the TENANT, <br />abandonment shall be presumed when: (a) the TENANT has been absent from the <br />Leased Premises for a period of thirty (30) consecutive days; and (b) the TENANT has <br />not notified the LANDLORD in writing of the absence being intended; and (c) the rent is <br />not current; and (d) ten (10) days have elapsed since service of a written notice on the <br />TENANT of the default and the LANDLORD'S intent to retake possession. <br />Page 18 of 38 <br />N:\Client Docs\Airport\Attachment B\2016.February.16.ATTACHMENT B.docx <br />
