River County Building Code Board of Adjustments and <br />Appeals at a specified time and place to show cause why <br />he should not comply with said notice. " <br />(4) UNSAFE BUILDINGS, Section 103.4(a)(5) is repealed. <br />(S) LIABILITY'. Section 103.7 is amendedto read: <br />"Any officer or employee, or member of the Board of <br />Adjustments and Appeals, charged with the enforcement <br />of any of the codes established by this resolution, act- <br />ing for the applicable governing body in the discharge of <br />Ills duties, shall not thereby render himself liable per- <br />sonally for ordinary negligence, and he is hereby relieved <br />from all personal liability for ordinary negligence for <br />any damage that may occur to persons or property as a <br />result of any act rewired or permitted In the discharge <br />of his duties. Any suit brought against any, officer or <br />employee because of such act performed by him in the <br />enforcement of any provision of such codes shall be <br />defended by the County Attorney (referred to herein as <br />The Department of Law) until the final termination of <br />the proceedings, " <br />(b) REPORTS. Section :1,03. B Is an'iended to read: <br />"The Building Official shall annually submit a report to <br />the County Administrator (herein referred to as the <br />Chief Administrator) covering the work of the Depart- <br />ment during the prc:cedi,ng year. Ile shall incorporate <br />In said report a summary of the decisions of the Board <br />of Adjustments and Appeals during; said year." <br />(7) WHEN I'13ltsMIT REQUIRED. Section 105. I(c) is amended <br />to read- <br />,. Ordinary <br />ead:„Ordinary minor, 11011 -structural repairs not exceeding <br />In cost or Value of labor or materials the :tune of one, <br />hundred dollars ($10). 00) or one percent (I%) of the: <br />assessed value of the building for County tax purposes, <br />whichever is less, may be made without the approval of <br />the Building; Official and without a permit; provided, that <br />such repairs shall not violatc any of the provisions of <br />this cock: and providt�d ftir thcr that this section does not <br />apply to plumbing or electrical work. ” <br />(8) FORM. Section 105.2 is amended by adding thereto the <br />following additional subsections: <br />"(c) Each application for a permit shall bear a current <br />certificate by the County Administrator (sometimes <br />referred to herein as the Director of Public Works) certi- <br />fying that (1) the building site, front yard, side yard, rear <br />yard, minimum floor and parking areas and (2) the build- <br />ing height and (3) the setback from any road, street or <br />highway existing or proposed in the county outside the <br />limits of any municipality, as shown on the application <br />and plot diagram (see Section 105. 4), comply with all <br />4 <br />
