project's eastern boundary, where the project abuts <br />residentially designated property. Along the eastern property <br />line, a Type C buffer with 6' opaque feature is provided. . <br />Based upon its review, staff has determined that the project: <br />OIs- consistent with the comprehensive plan and LDRs, as it <br />meets all use and density standards and meets all applicable <br />PD requirements. <br />•Is compatible with surrounding land rise based upon physical <br />separation, proposed buffering, and internal lot <br />configuration. <br />*Has no adverse impacts on public health, safety, and welfare <br />since the project meets all utilities, environmental health, <br />and traffic requirements and proposes single family <br />residential units. <br />•Promotes orderly development in its relation to the <br />surrounding area's residential land use designation and <br />surrounding roadways. <br />•Status of Preliminary PD Plan <br />The preliminary PD plan was approved by the Planning and Zoning <br />Commission with the following conditions: <br />A. That the applicant obtain from the Board of County <br />Commissioners PD special exception use approval. <br />B. That prior to the issuance of a land development permit for <br />any phase of the project, the applicant shall: <br />1. Obtain a county wetland resource permit and all <br />applicable jurisdictional agency permits for filling and <br />modifying wetlands on site. <br />2. Apply for and obtain from planning staff a mining permit <br />exemption subject to the criteria of LDR section <br />934.04(7)(b). <br />3. Obtain county approval for and execute an agreement with <br />the county for paving 1st Street S.W. between 58th Avenue <br />and 43rd Avenue. <br />4. Obtain approval from the -county for the design of the <br />deceleration and turn lane improvements at the <br />intersection of 1st Street S.W. and the project entrance <br />road. <br />C. Prior to the issuance of a certificate of completion for any <br />phase of the project: <br />1. 1st Street S.W. shall be paved from 58th Avenue to 43rd <br />Avenue, in accordance with an executed agreement between <br />the developer and the county. <br />2. The deceleration and turn lane improvements at the <br />intersection of 1st Street S.W. and the project entrance <br />road shall be completed, and deemed acceptable ,by the <br />public works department. <br />If the Board of County Commissioners grants the special exception <br />use request, then the preliminary PD plan approval, with the <br />conditions stated above, will become effective. <br />RECOMMENDATION: <br />Staff recommends that the Board of County Commissioners grant the <br />requested PD special exception use approval and corresponding <br />request for waivers as described in item 18 of this report. <br />SEPTEMBER 26, 1995 23 BOOK 96 FAGS 228 <br />
