M <br />•Wetlands: The overall 5.57 acre site contains 1.46 acres of <br />jurisdictional wetlands. The proposed project will leave the <br />entire 1.46 acres of wetlands undisturbed. Therefore, a <br />county wetland resource permit is not. required for the <br />proposed development. <br />•Habitat: Environmental planning staff has determined that <br />the area of development does not contain habitat that may <br />harbor endangered plant or animal species. Therefore, a <br />habitat analysis of the site is not required. <br />17. Dedications and Improvements: Currently, 150' of Indian River <br />Boulevard right-of-way exists adjacent to the subject site. <br />In order to provide for the 200' ultimate right-of-way for the <br />Boulevard, 25' of additional right-of-way will be needed .from <br />the site. The Public Works Director has indicated that the <br />county will purchase the additional 25' of Boulevard right-of- <br />way. Public works staff indicate that they are currently <br />negotiating with the applicant for the right-of-way purchase. <br />These negotiations are handled separately from this site plan <br />application. The proposed site plan is designed to <br />accommodate the 25' dedication. <br />18. Special Exception General Review Criteria: In its review of <br />this application, staff has made the following findings in <br />regard to the general review criteria for special exception <br />uses found in LDR section 971.05(7) and (9): <br />1. Ingress/egress and traffic safety have been adequately <br />addressed in the site's access, parking lot, and building <br />access layout. All county codes relating to these issues <br />are satisfied. <br />2. Off-street parking and loading areas have been adequately <br />provided including provisions for overflow parking and a <br />separate, covered drop-off area for residents. <br />3. Utilities in the form of public water and sewer service <br />have been adequately provided. <br />4. Screening and buffering have been adequately provided, <br />including landscape plantings between parking space and <br />driveway areas and Indian River Boulevard, and between <br />the proposed building and 4th Court. <br />5. Signs and lighting have been addressed in the site plan <br />review and meet all county requirements. <br />6. Required yards and open space have been accommodated by <br />the proposed design, including accommodation of setbacks <br />after the acquisition of 25' of Indian River Boulevard <br />right-of-way from the site. <br />7. Consistency with the comprehensive plan and LDRs: As <br />described in this report, the proposed use, intensity, <br />and site plan design are in accordance with the <br />comprehensive plan and LDRs. <br />8. Compatibility with surrounding uses: The project <br />intensity, location, and screening is adequate to ensure <br />compatibility with surrounding uses. <br />9. Public health, safety, and welfare: No adverse impacts on <br />public health, safety, and welfare are anticipated since <br />the project design meets all utility services, <br />environmental health, and traffic and drainage <br />engineering requirements. <br />BOOK 96 T-tU.20.3 <br />SEPTEMBER 26, 1995 31 <br />
