directed staff to obtain all the right-of-way necessary to pave <br />this project. Recently, the necessary right-of-way has been <br />obtained. 500 of all right-of-way acquisition costs have been <br />included in the assessment costs. The Public Works Department <br />staff will meet with the homeowners at an informal meeting to be <br />held on October 10, 1995 in these chambers. All property owners in <br />the benefited area were sent notice for this informal meeting. <br />A separate resolution will need to be adopted to hold a Public <br />Hearing to discuss the advisability, cost and amount of the <br />assessment against each property owner. <br />This Public Hearing has been scheduled for Tuesday, October 24, <br />1995 at 9:05 A.M. in the County Commission Chambers. <br />An assessment roll and plat has been prepared and filed with the <br />Clerk to the Board of County Commissioners. <br />RECOMMENDATION AND FUNDING <br />It is recommended that the Board: <br />1) Adopt the resolution providing for the paving and drainage <br />improvements for the project subject to the terms outlined in <br />the resolution. The applicable interest rate shall be <br />determined at the time the final assessment roll is approved. <br />2) Allocate $447,023.62 from the Transportation Fund. <br />3) Adopt a resolution setting the time and place of the Public <br />Hearing. <br />Public Works Director Jim Davis advised that staff prepared <br />the tentative assessment roll based on approximately $22 a front <br />foot, but since that time some properties have been sold and some <br />properties have been fragmented such that they do not have frontage <br />on 1st Street SW. These properties will benefit from the paving of <br />the road because they must use the road to access the property. In <br />looking at it further, staff feels a per acre assessment would be <br />more equitable and attribute a portion of the cost to that one <br />parcel that has no frontage. Staff is recommending that the <br />proposed resolution be changed to reflect a front footage <br />assessment to an acreage assessment. It will only take a few minor <br />changes in wording to accomplish that. <br />Director Davis advised when the petition was submitted by <br />residents in the area back in the late 1980s, it was recognized <br />that we had a 30 -ft. road right-of-way for 1st Street SW and to <br />accomplish the project we would need to acquire one mile of right- <br />of-way along the section between 58th Avenue and 66th Avenue. <br />We acquired 17 parcels from different owners and we were successful <br />in completing all the right-of-way acquisition without going to <br />eminent domain.
