But, until then, his recommendation and vote <br />would be to approve the transfer subject to the acceptance of the <br />requirements recommended by Director Pinto. <br />Director Pinto read aloud the following requirements that must <br />be agreed to in writing by Ellenburg prior to.'the approval of the <br />franchise transfer: <br />1) Required to have a Florida legal firm representing them so that <br />we can make direct contact here in Florida, not Oregon. <br />2) Required to have a 24-hour contact with a maintenance company <br />that is approved by the County that operates the treatment <br />plant. <br />3) That maintenance company must have the ability to spend up to <br />$10,000 for emergency repair immediately upon failure. <br />4) That the R & R requirements be increased from 22% to 30 on an <br />annual basis because of the condition of the treatment plant. <br />5) That the amount in the R & R fund never be reduced below <br />$30,000. This means that even if they have legitimate <br />expenditures, they cannot reduce the fund below $30,000. <br />6) That all interest earned on the account be kept in the account <br />to increase the amount in the account so that there is more <br />money there to service a maintenance problem if one occurs. <br />7) Chlorides and total solid particles in the drinking water must <br />be tested daily and DER results reported to Indian River County <br />Utilities Department, with copies placed on the bulletin board <br />in the Homeowners' Association common area on a weekly basis. <br />8) Upon connection to the County water system by the year 2002, <br />all the funds in the R & R fund are to be used for upgrading <br />the internal distribution system. <br />9) Penalty fees for non-compliance are to be increased from $50 to <br />$500.
