He expected to have the <br />franchise signed in two weeks and back before the Board in two <br />weeks. If not, he suggested that the Board take Ellenburg to court <br />and look for a receiver. <br />Attorney Brandenburg assured the Board that Ellenburg would <br />have the agreement back in a week. <br />MOTION WAS MADE by Commissioner Adams, SECONDED by <br />Commissioner Bird, to authorize staff to arrange for <br />a new franchise with the 11 requirements read aloud <br />by Director Pinto with the stipulation that we have <br />a signed acceptance from Ellenburg Capital within <br />two weeks from today; with the understanding that <br />the 6% franchise fee is waived for Ellenburg Capital <br />and that Ellenburg Capital will submit expenditures <br />on repairs to show they are legitimate expenses. <br />Under discussion, Attorney Vitunac advised that there is no <br />meeting in two weeks, but Commissioner Adams stressed that the two <br />weeks is still the deadline for receiving their written acceptance. <br />Commissioner Bird wanted to see this back on the Agenda for <br />the meeting of November 7, 1995. <br />Executive Aide Alice White asked for clarification of <br />expenditures, and Chairman Macht restated that Ellenburg is to <br />furnish invoices on repairs they made to show that the cost is at <br />least the amount in the Renewal & Replacement account. <br />THE CHAIRMAN CALLED FOR THE QUESTION.
