BOOK 96 Pr,•,,E360 <br />Due to recent changes in the LOGT legislation, any interlocal agreements <br />approved must contain a provision which requires a two year review of <br />distribution methods and percentages. The legislation allows the distribution <br />formula to be approved by interlocal agreements between the County and <br />municipalities containing at least fifty percent of the total incorporated area <br />population. If interlocal agreements are not approved, the funds are distributed <br />based upon the percentage of total transportation expenditures that each eligible <br />municipality and the County has expended over the previous five-year period. <br />Prior to 1994, the City of Vero Beach has contained at least 50% of the total <br />incorporated population. In 1994, that percentage dropped to 49.47%. <br />ALTERNATIVES AND ANALYSIS <br />On October 5, 1995, the County staff met with representatives of all five <br />municipalities to discuss extending the program and consideration of a <br />distribution formula. Four municipalities; Fellsmere, Sebastian, Indian River <br />Shores, and the Town of Orchid,, expressed preference to continue using the <br />existing three parameter formula. Since the City of Vero Beach's population is <br />remaining fairly constant and all other entities are gaining population, Vero <br />Beach's distribution percentage is dropping approximately 2.2%. Vero Beach is <br />projected to receive $66,000 less revenue annually if the existing formula is <br />continued: Vero Beach, understandably, could not support continued usage of <br />the 3 parameter formula but recommended the distribution option based solely <br />upon past transportation expenditures, whereby the City share would increase <br />1.2% or $36,000 per year. The meeting amicably adjourned, but without a <br />unanimous consensus. <br />Staff presents the following alternatives: <br />Alternative No. 1 <br />Instruct staff to prepare interlocal agreements for transmittal to all <br />five municipalities which contain the same distribution formula that <br />has been in effect over the past 10 years. The three formula <br />parameters (population, equivalent lane miles of roadway, and past <br />five year transportation expenditures), will be equally weighed in <br />calculating a distribution percentage.
