<br />THIS DEED, made this day of November, 1970, by INDIAN
<br />RIVER COUNTY, FLORIDA, party of the first part, and THE STATE OF
<br />FLORIDA, BOARD OF TRUS'T'EES OF THE INTERNAL. IMPROVEMENT
<br />TRUST FUND, party of the second part.
<br />® WITNESSETH, that the said party of the first part, for and in
<br />consideration of the sum of Ten and no/100 Dollars ($10. 00) to it in hand
<br />paid by the party of the second part, receipt whereof is hereby acknowledged
<br />and other good and valuable considerations, has granted, bargained and sold
<br />to the party of the second part, its successors and assigns forever, the
<br />following described land lying, and being in Indian River County, Florida:
<br />From the Southeast corner of Section 20, Township 30 South, Range
<br />39 East, Indian River County, Florida, run North 89 degrees 31 minutes West
<br />along the South line of said Section 20 a distance of 3505.98 feet to the point
<br />of beginning; thence North 31 degrees 21 minutes 01 seconds East 1620.0 feet;
<br />thence North 34 degrees 51 minutes 43 seconds East 928. 84 feet; thence North
<br />11 degrees 48 minutes East 332.01 feet; thence South 37 degrees 42 minutes
<br />22 seconds West 435.0 feet; thence South 53 degrees 42 minutes 22 seconds
<br />West 230. 0 feet; thence South 41 degrees 05 minutes 32 seconds 4k est 350. 0 feet;
<br />thence South 04 degrees 59 minutes 36 seconds West 7.40.0 feet; thence South
<br />31 degrees 21 minutes 01 seconds West 1741.80 feet; thence run South 89 degrees
<br />31 minutes East a distance of 168. 93 feet, more or less, to the point of beginning
<br />and from the Southeast corner of Section 20, Township 30 South, Mange 39 East,
<br />Indian River County, Florida, run North 89 degrees 31 minutes West along the
<br />South line of said Section 20, a distance of 2891. 01 feet to the point of beginning;
<br />thence continue along this sarne bearing 783. 90 feet; thence run South 31 degrees
<br />21 minutes 01 seconds West 1213. 20 feet to a point of tangency of a circular curve;
<br />thence continue on the arc of said circular curve concave to the left, having a
<br />radius of 485 feet a distance of 1904. 59 feet to a point; thence run North 24 degrees
<br />24 minutes 21 seconds East a distance of 1281. 79 feet, more or less to the
<br />point of beginning
<br />Subject to conditions, reservations, limitations, easements, questions
<br />of survey and agreements, if any there be.
<br />Grantor does not warrant condition of title. Grantor will defend title
<br />against the claims of any person claiming by, through or under the Grantor herein.
<br />It is agreed and understood by and between the parties, and the party
<br />of the second part, by its acceptance of this Deed, does acknowledge its under-
<br />standing of the agreement and does covenant and agree for itself, and its
<br />successors and assigns, forever, as follows:
<br />1. The premises above described shall be forever and continuously
<br />used and maintained as and for a public park for recreational purposes and no
<br />part of said premises is to be confined or used as a restricted campground or
<br />other restricted area.
<br />2. That day or night free access to all of the South shoreline of the
<br />Sebastian Inlet, the fishing pier, under the Sebastian Inlet Bridge and the South
<br />Jetty of the Sebastian Inlet, will be provided by the party of the second part for
<br />the use and enjoyment of all citizens and that no special charge will ever be made
<br />for the exercise of such enjoyment.
<br />IN WITNESS WHEREOF, the said Harty of the first part has caused
<br />these presents to be executed in its name by Its Board of County Commissioners
