Brown, County Administrator <br />Kristin Daniels, Budget Director <br />FROM: Jennifer Hyde, Purchasing Manager <br />SUBJECT: Approval of Agreement with CW Roberts Contracting, Inc. for Asphalt Paving and <br />Resurfacing <br />BACKGROUND: <br />On June 23, 2020, the Board awarded annus! bid 2020042 to Community Asphalt Corp. and C.W. <br />Roberts Contracting, Inc. ("CWR") for asphalt paving and resurfacing services. The work includes <br />materials, equipment, labor and Maintenance of Traffic (MOT) required to complete the work as <br />requested by the Road and Bridge Division under the pavement management program. <br />The initial term of award was July 2, 2020 through July 1, 2021, with two one-year renewals <br />available. The Public Works Department elected not to renew the award to Community Asphalt <br />Corp. due to a lack of responsiveness and timely completion of work. CWR has performed well <br />under the bid, and the first renewal was executed by the Purchasing Manager, as authorized by <br />the Board, effective July 2, 2021. <br />DISCUSSION: <br />The bid was issued in accordance with all federal requirements, and included a sample agreement <br />with federal terms, in the event the work. might be needed under federal grant. Due to the <br />urgency of paving work to be done at the time of award, and not anticipating federal funding for <br />any work at that time, staff requested and the Board approved the execution of work under the <br />bid via purchase order, rather than execute the formal agreement. <br />On August 17, 2021, the Board approved revisions to the American Rescue Plan Act spending plan, <br />in part based on updated Treasury guidance that makes roadway resurfacing and striping eligible <br />for use of our allocated funding. Staff would like to utilize the existing bid with CWR to execute <br />resurfacing work under the ARP, and therefore would like to formally execute the agreement. <br />134 <br />
