Boa 96 pAfJE 476 <br />The applicant changed the configuration of Subject Property 4 in <br />response to public comment. At the Planning and Zoning Commission, <br />public hearing, several owners of residential property to the east <br />raised objections to the redesignation of the northeastern tract of <br />Subject Property 4. For that reason, the applicant has eliminated _ <br />the northeastern tract, and moved those, 0.7 acres to the <br />southwestern tract. <br />The purpose of this request is to secure the necessary zoning and <br />land use designation to allow commercial development on subject <br />properties 2, 3 and 4. <br />On April 271 1995, the Planning and Zoning Commission voted 4-2 to <br />recommend that the Board of County Commissioners transmit the <br />proposed land use amendment, with the exception of the northeastern <br />tract of Subject Property 4, to the State Department of Community <br />Affairs (DCA) for their review. <br />On June 13, 1995, the Board of County Commissioners voted 5-0 to <br />transmit the proposed land use amendment request to DCA for their <br />review. <br />Consistent with state regulations, DCA reviewed the proposed <br />amendment and prepared an Objections, Recommendations and Comments <br />(ORC) Report. The ORC Report, which planning staff received on <br />September 5, 1995, did not contain any objections to the proposed <br />amendment. The ORC Report did, however, contain one comment <br />pertaining to the proposed amendment. That comment will be <br />addressed in the analysis section of this staff report. In <br />contrast to objections, comments cannot be used as a basis for <br />finding an adopted amendment not in compliance. <br />The Board of County Commissioners is now to decide whether or not <br />to adopt the requested land use amendment. At this time, the Board <br />must also act on the proposed rezoning <br />Existing Lard Use Pattern <br />Subject Property 1 <br />Subject Property 1 is zoned IL and, except for approximately 1.6 <br />vacant acres in the northwest part of the site, consists of an <br />abandoned citrus grove. Land to the east, across 55th Avenue, is <br />also zoned IL and contains Ron's Island Court Mobile Home Park, a <br />legally established non -conforming use. The John's Island Club - <br />West Golf Course, abutting the site on the north, as well as the <br />wooded area to the west, are zoned RM -6. South of the western <br />portion of the site, on RM -6 zoned property, is another legally <br />established non -conforming mobile home park. East of that mobile <br />home park and south of Subject Property 1 is a vacant wooded area. <br />The northern part of that area is zoned IL, while the southern part <br />is zoned CL. <br />- Subject Property 2 <br />Subject Property 2 is zoned A-1. Except for 1 storage building in <br />the northwest corner, the site consists entirely of abandoned <br />citrus grove. RM -6 zoned land borders the site on all sides except <br />for the west, which is zoned CL. A square shaped parcel containing <br />a single-family house abuts the southeastern portion of Subject <br />Property 2 on two sides. To the south of Subject Property 2, <br />_across 92nd .Street, are several' single-family houses. Currently <br />vacant, land to the west of Subject Property 2 was formerly the <br />site of the Classic Gardens Nursery.
